WHEREAS, the Town of Wappinger is a parry to an Article 78 Proceeding entitled Mid -Hudson Development Corp. and Mid Hudson Holdings LLC v The Town of Wappinger, the Town Board of Wappinger, and the Town of Wappinger Planning Board, currently pending in the Supreme Court, State of New York, County of Dutchess bearing index number 2025-51354 (the "Proceeding"), and WHEREAS, after extensive litigation and negotiations, the Town Board wishes to authorize Hogan, Rossi and Liguori to settle the matter pursuant to a Stipulation of Settlement, a copy of which is annexed hereto; NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger hereby approves and ratifies the settlement of the Proceeding on the terms indicated in the Stipulation; and BE IT FURTHER RESOLVED, that the Firm of Hogan & Rossi, is hereby authorized and directed to sign, on behalf of the Town of Wappinger said Stipulation of Settlement in the form annexed hereto.
