Resolution Authorizing The Establishment Of An Escrow Account For Myers Corner LLC
(Degarmo Hills Plaza) In Connection With Their Application To Connect To The United
Wappinger Sewer District
At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on April 27,
2026.

The following Resolution was introduced by Casella and seconded by Councilwoman
O'Dell.
WHEREAS, Myers Corner LLC, owner of DeGarmo Hills Plaza, has proposed work
associated with connecting the subject property to the United Wappinger Sewer District
(UWSD); and
WHEREAS, the Town of Wappinger requires the establishment of an escrow account to
cover professional review, inspection, and administrative costs associated with such work;
and
WHEREAS, Myers Corner LLC has agreed to fund said escrow account in the amount of
Five Thousand Dollars ($5,000.00) to be held by the Town for the purposes described
herein; and
WHEREAS, the Town Board finds that the establishment of such escrow account is in the
best interests of the Town to ensure that all costs associated with the review and
inspection of the proposed connection are properly funded without burdening taxpayers;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger hereby
authorizes the establishment of an escrow account for Myers Corner LLC (DeGarmo Hills
Plaza) in the amount of $5,000.00 for work associated with connecting to the United
Wappinger Sewer District (UWSD); and
BE IT FURTHER RESOLVED, that said escrow funds shall be utilized by the Town to cover
engineering, legal, inspection, and administrative costs incurred in connection with the
review and approval of the proposed work; and
BE IT FURTHER RESOLVED, that any unused portion of the escrow funds shall be returned
to Myers Corner LLC upon completion of the project and satisfaction of all outstanding
obligations, and any additional funds required beyond the initial escrow amount shall be
the responsibility of Myers Corner LLC; and
BE IT FURTHER RESOLVED, that Town Supervisor Joseph D. Cavaccini and/or his designee
are hereby authorized to take any and all actions necessary to effectuate the intent of this
resolution.
