Resolution Approving Settlement Of Mid Hudson Development Corp. And Mid Hudson
Holdings LLC V. Town Of Wappinger, Et Al.
WHEREAS, the Town of Wappinger is a parry to an Article 78 Proceeding entitled Mid -Hudson
Development Corp. and Mid Hudson Holdings LLC v The Town of Wappinger, the Town
Board of Wappinger, and the Town of Wappinger Planning Board, currently pending in the
Supreme Court, State of New York, County of Dutchess bearing index number 2025-51354 (the
"Proceeding"), and

WHEREAS, after extensive litigation and negotiations, the Town Board wishes to
authorize Hogan, Rossi and Liguori to settle the matter pursuant to a Stipulation of Settlement, a
copy of which is annexed hereto;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of
Wappinger hereby approves and ratifies the settlement of the Proceeding on the terms indicated
in the Stipulation; and
BE IT FURTHER RESOLVED, that the Firm of Hogan & Rossi, is hereby authorized
and directed to sign, on behalf of the Town of Wappinger said Stipulation of Settlement in the
form annexed hereto.

Adopting Local Law No. 8 Of 2026 Which Would Declare That The Instrument Filed
With The New York Secretary Of State As Local Law No. 1 Of 2020 Of The Town Of
Wappinger Is Void Ab Initio For Failure To Comply With The Requirements Of The
Municipal Home Rule Law
WHEREAS, the Town Board has considered the adoption of Local Law No. 8 Of 2026
Which Would Declare That The Instrument Filed With The New York Secretary Of State As Local
Law No. 1 Of 2020 Of The Town Of Wappinger Is Void Ab Initio For Failure To Comply With The
Requirements Of The Municipal Home Rule Law"; and
WHEREAS, a Public Hearing on the proposed Local Law was duly advertised in the
Southern Dutchess News and the Poughkeepsie Journal as required by law; and
WHEREAS, a Public Hearing was held on April 13, 2026 and all parties in attendance were
permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or any
part thereof; and
WHEREAS, the Town Board has determined that the Proposed Action is an action for

which there are no other Involved Agencies and that the Town Board is therefore, by default, the
Lead Agency for this action; and
WHEREAS, said Local Law has been on the desks of the members of the Town Board of
the Town of Wappinger for at least ten (7) days prior to the adoption of this resolution.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
The Town Board hereby adopts and incorporates the recitations and statements set
forth above as if fully set forth and resolved herein.
2. The Town Board, after due deliberation, finds that it is in the best interest of the
Town to adopt said Local Law, and the Town Board hereby adopts Local Law No. 8
of 2026, a copy of which is attached hereto and made a part of this Resolution; and
3. The Town Clerk is directed to enter said Local Law in the minutes of this meeting into the
Local Law book for the Town of Wappinger and to give due notice of the adoption of said Local
Law to the Secretary of State of New York.

COMMENTS - Current Meeting:
Grace Martin from fieldstone thanked the board for supporting the resolution declaring April as
Autism Acceptance month.
Suzane Brudnack of 11 Sucich place supported the upzoning that would benefit their quiet
neighborhood.
Debra Arroyo of 13 Sucich place asked all in the room to stand who opposed building behind
Sucich place. All in attendance stood. She explained how the aesthetics of the town need to be
preserved. She pointed out the continued stress on the schools, roads, and the increased taxes.
Marcy Wagman of Old Troy Road spoke on reducing the available building space or supporting
the upzone to 5 -Acre zoning pointing out that government serves the needs of the residents not
non-resident and/or commercial opportunists looking to profit at our expense.

WHEREAS, Robert Ceru, verbally submitted his resignation as a Solid Waste Attendant for the Town
of Wappinger Recycle Center effective April 8, 2026.
NOW, THEREFORE, BE IT RESOLVED, as follows;
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. The Town Board hereby accepts the resignation of Robert Ceru as a Solid Waste Attendant
for the Town of Wappinger Recycle Center effective April 8, 2026.
3. The Town Comptroller, Daniel Tucker, is directed to compute any sums due to Robert Ceru.

RESOLUTION: 2026-97
Resolution Appointing Seasonal Laborers In The Buildings And Grounds Department
WHEREAS, the Town Board has determined that hiring seasonal employees in the Buildings and
Grounds Department to assist with the repairs and maintenance of Town owned parks and facilities
is necessary, and
WHEREAS, the Rules of the Dutchess County Department of Human Resources authorizes the
appointment of employees by the Town on a seasonal basis, and
WHEREAS, Town Supervisor Joseph D. Cavaccini and Supervisor of Buildings and Grounds
Salvatore Messale recommend the appointment of five employees as full time seasonal Laborers in
the Buildings and Grounds Department, and
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board hereby appoints Thomas Johnston as Seasonal Laborer who shall be
compensated at $21.33 per hour with a starting date retroactive to April 6, 2026
2. The Town Board hereby appoints Francis Steinhauer as Seasonal Laborer who shall be
compensated at $21.33 per hour with a starting date retroactive to April 8, 2026.
3. The Town Board hereby appoints William Moloney as Seasonal Laborer who shall be
compensated at $21.00 per hour with a starting date of April 13, 2026.
4. The Town Board hereby appoints Rafael Mendez Santiago as Seasonal Laborer who
shall be compensated at $21.00 per hourwith a starting date of April 20, 2026.
5. The Town Board hereby appoints Ryan Tomlins as Seasonal Laborer who shall be
compensated at $21.00 per hour with a starting date of April 20, 2026.
6. This appointment is a seasonal appointment in accordance with the rules of the
Dutchess County Department of Human Resources.
7. This appointment is subject to the approval of the Dutchess County Department of
Human Resources and is further subject to Civil Service Law and the Rules of New York
State and the Dutchess County Department of Human Resources.
8. Directs the Personnel Administrator to complete all necessary documentation for said
appointments to be filed with the Dutchess County Department of Human Resources.
The 2026 Budget makes appropriations for these positions.

RESOLUTION: 2026-98
Resolution Declaring SEQRA Negative Declaration On Proposed Improvements To
Wildwood Wastewater Trea
WHEREAS, the Town of Wappinger has proposed implementing design changes to the Wildwood
Wastewater Treatment Plant (hereinafter referred to as WWTP); and
WHEREAS, recommended improvements include the relocation of the existing effluent discharge
outfall, which was the most cost-effective choice and will extend the useful service of the existing WWTP
and will be pursued by the Town Board; and
WHEREAS, pursuant to 6 NYCRR 617.6 the Town Board sought to be established as Lead Agency as
part of a coordinated review of this action with the identified Involved and Interested Agencies by
Resolution 2026-67; and
WHEREAS, the Town Board authorized the Secretary to the Town Supervisor Kaitlyn Aboshanab to
send out a Notice of Intent to all Involved and Interested Agencies on March 4, 2026, and
WHEREAS, the Town Board received no objections to their request to serve as Lead Agency; and
WHEREAS, the Town Board has classified this action as an Unlisted Action and prepared a Short Form
Environmental Assessment Form (SEAF) Part 1, 2, and 3 for the proposed project.
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Wappinger duly
convened as follows:
1. The Town Board, upon due deliberation of SFEAF Parts 1, 2, and 3 finds that the proposed action
will not result in any significant adverse environmental effects; and
The Town Board of the Town of Wappinger as Lead Agency, hereby issues a Negative Declaration
pursuant to the requirements of the SEQRA and authorizes Town Supervisor Joseph D. Cavaccini to sign
any and all documents under SEQRA, closing the SEQRA review of this project.

Resolution Declaring April As Child Abuse Prevention Month
WHEREAS, children are our community's most valuable resource and deserve to grow up in
a safe, nurturing, and supportive environment; and
WHEREAS, child abuse and neglect remain serious issues that affect families and
communities, with lasting impacts on a child's physical, emotional, and developmental
well-being; and
WHEREAS, preventing child abuse requires the collective commitment of residents,
families, educators, service providers, and community leaders working together to support
and strengthen families; and
WHEREAS, increasing awareness, promoting education, and providing resources to
parents and caregivers are essential to preventing abuse and ensuring the well-being of
children; and
WHEREAS, April is recognized nationwide as Child Abuse Prevention Month, symbolized by
the blue ribbon as a reminder of the importance of protecting children and supporting
families; and
WHEREAS, the Town of Wappinger is committed to fostering a safe, supportive, and
inclusive community where all children can thrive;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger, do
hereby proclaim the month of April as Child Abuse Prevention Month in the Town of
Wappinger; and
BE IT FURTHER RESOLVED, that all residents are encouraged to play an active role in
supporting families, reporting suspected abuse, and promoting the well-being of children
in our community; and
BE IT FURTHER RESOLVED, that the Town of Wappinger will illuminate Town Hall in blue
throughout the month of April in recognition of Child Abuse Prevention Month and as a
symbol of our commitment to protecting children; and

WHEREAS, the sport promotes physical activity, community engagement, and lifelong
wellness by providing an inclusive recreational opportunity for residents of all
backgrounds; and
WHEREAS, pickleball brings together neighbors, friends, and families, strengthening
community bonds and enhancing quality of life throughout the Town of Wappinger; and
WHEREAS, the Town of Wappinger continues to invest in parks and recreational amenities
that encourage active lifestyles, including Martz Field Recreation Facility, that support the
growing popularity of pickleball; and
WHEREAS, April is recognized nationwide as National Pickleball Month, a time to celebrate
the sport's growth and encourage participation at all levels; and
WHEREAS, promoting recreational opportunities such as pickleball aligns with the Town's
commitment to health, wellness, and community vitality;

Resolution Declaring April As Donate Life Month In The Town Of Wappinger
WHEREAS, organ, eye, and tissue donation offers hope and healing to thousands of
individuals and families awaiting life-saving and life -enhancing transplants; and
WHEREAS, more than 100,000 individuals across the United States are currently on the
national transplant waiting list, with many more in need of tissue and cornea donations;
and
WHEREAS, a single organ donor can save up to eight lives and enhance the lives of many
others through tissue and cornea donation; and
WHEREAS, National Donate Life Month is observed each April to raise awareness about the
importance of registering as an organ, eye, and tissue donor and to honor those who have
given the gift of life; and
WHEREAS, the Town of Wappinger recognizes the generosity of donors and their families,
as well as the dedication of medical professionals and organizations that make
transplantation possible; and
WHEREAS, increasing public awareness and encouraging donor registration can help save
lives and strengthen communities;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger, do
hereby proclaim the month of April as National Donate Life Month in the Town of
Wappinger; and
BE IT FURTHER RESOLVED, that all residents are encouraged to learn more about organ,
eye, and tissue donation, to consider registering as donors, and to share their decision with
their families; and

communication, behavior, and social interaction; and
WHEREAS, individuals with autism contribute greatly to the strength, diversity, and
vibrancy of our community, and deserve to be recognized, respected, and supported; and
WHEREAS, increasing awareness and understanding of autism fosters acceptance,
inclusion, and meaningful opportunities for individuals with autism to live, work, and thrive
in our community; and
WHEREAS, the Town of Wappinger is committed to promoting equity, dignity, and inclusion
for all residents, including those on the autism spectrum and their families; and
WHEREAS, April is recognized nationwide as Autism Acceptance Month, a time to move
beyond awareness toward genuine acceptance, inclusion, and appreciation of
neurodiversity; and
WHEREAS, it is important to celebrate the unique talents and perspectives of individuals
with autism, while also supporting efforts to improve access to education, employment,
and community engagement opportunities;

Motion To Amend The Town Zoning Map To Add Identified Areas To R -5a: One -Family
Residence (5 Acre) Zone, Provide Greenway Findings & Declare Lead Agency For This
Proposed Action
WHEREAS, the Town of Wappinger Town Board (hereafter Town Board), believes that changes to the
Official Zoning Map are necessary to provide for the quality layout and management of future residential
land use and development; and
WHEREAS, the Town Board, therefore, proposes to downzone specified areas to R -5A: One -Family
Residence (5 Acre) District that are currently in R-20, R20/40, R40, R40/80 & R-80 Zones, with this
downzoning explicitly described in proposes Local Law : Zoning Map Amendment to Add Identified
Areas to the R -5A: One -Family Residence (5 Acre) Zone covering xx parcels and xx acres in order to
assist providing for orderly growth; and
WHEREAS, the adoption of the 2025 Plan Updates and Zoning Amendments is an Unlisted action
based on a review of SEQRA, NYCRR 617.4 - Type I Actions, and 617.5 - Type II Actions; and
WHEREAS, since the Town Board is the only entity that can legislatively adopt this Zoning Map
Amendment, the Town Board seeks to serve as the Lead Agency for this proposed action; and
WHEREAS, the Town Board prepared and reviewed Part 1 of a Full Environmental Assessment Form
("FEAF") as part of advancing review of this proposed action; and

WHEREAS, the proposed action would not involve a federal agency; and
WHEREAS, the Town Board is required to refer Zoning amendments to the Town of Wappinger
Planning Board for its report thereon per Town Zoning §240-112.B Advisory Report by Planning Board;
and
WHEREAS, the Town Board is required to provide a statement on the relationship of this proposed
zoning amendment with Dutchess County Greenway Connections per Zoning §240-112.A.3 Greenway
Connections.
NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Wappinger in regular
session duly convened as follows:
The Town Board of the Town of Wappinger hereby determines that this Zoning Map
change is an Unlisted Action under SEQRA; and
2. The Town Board hereby declares its interest and intent to serve as the Lead Agency
pursuant to SEQRA and its implementing regulations at 6 NYCRR §617.6 (b)(2)(1), with
respect to the proposed action to add areas to amend the Official Zoning Map by adding
additional areas to the R -5A Zoning District, and the Town Board hereby directs the
Town Clerk to circulate a notice to the identified involved and interested agencies on this
action, its classification, and undertaking of procedures to establish the lead agency and
perform a coordinated review.
The Town Board hereby makes the finding regarding Greenway Connections
Consistency as per the Memorandum by Christopher P. Spencer, Planning Services
Manager, Laberge Group, October 31, 2025 entitled Greenway Consistency - R -5A: One -
Family Residence (5 Acre) Zoning Map Amendment.
The Town Board hereby directs the referral of the proposed R -5A Zoning Map Amendments to the
Wappinger Planning Board for review and recommendation.

Resolution Introducing Local Law Amending Chapter 230 "Vehicles And Traffic" Of The
Town Code Of The Town Of Wappinger To Regulate Parking On Myers Corners Road

WHEREAS, a proposed Local Law entitled "A Local Law Amending Chapter 230-46, 47, and
48 of the Town Code Limiting Parking on Myers Corners Road" has been introduced before
the Town Board of the Town of Wappinger; and
WHEREAS, the purpose of said Local Law is to prohibit parking, stopping, and standing on
Myers Corners Road from its westernmost intersection with Old Myers Corners Road to its
intersection with U.S. Route 9; and
WHEREAS, the Town Board has been advised by the Wappingers Central School District
and the Dutchess County Sheriff's Office that vehicles parked along Myers Corners Road
have created unsafe conditions by restricting traffic flow, limiting pedestrian access, and
increasing the risk of accidents; and
WHEREAS, the Town Board finds that prohibiting parking, stopping, and standing along this
corridor will alleviate congestion and improve roadway safety; and
WHEREAS, the Town Board further finds that the enactment of this Local Law is in the best
interest of the public health, safety, and welfare of the residents of the Town of Wappinger;
and
WHEREAS, the Town Board is required to conduct a public hearing prior to the adoption of
said Local Law;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger will
hold a Public Hearing on the proposed Local Law at 7:00 p.m. on the 27 day of April, 2026,
at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, or via such other means as
may be designated by the Town Board; and
BE IT FURTHER RESOLVED, that all persons interested in the subject matter thereof shall
be heard at such time and place; and
BE IT FURTHER RESOLVED, that the Town Clerk is hereby authorized and directed to cause
a notice of such Public Hearing to be published in the official newspaper of the Town in
accordance with law.

WHEREAS, the Town of Wappinger is a parry to an Article 78 Proceeding entitled Mid -Hudson
Development Corp. and Mid Hudson Holdings LLC v The Town of Wappinger, the Town
Board of Wappinger, and the Town of Wappinger Planning Board, currently pending in the
Supreme Court, State of New York, County of Dutchess bearing index number 2025-51354 (the
"Proceeding"), and
WHEREAS, after extensive litigation and negotiations, the Town Board wishes to
authorize Hogan, Rossi and Liguori to settle the matter pursuant to a Stipulation of Settlement, a
copy of which is annexed hereto;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of
Wappinger hereby approves and ratifies the settlement of the Proceeding on the terms indicated
in the Stipulation; and
BE IT FURTHER RESOLVED, that the Firm of Hogan & Rossi, is hereby authorized
and directed to sign, on behalf of the Town of Wappinger said Stipulation of Settlement in the
form annexed hereto.

Requirements Of The Municipal Home Rule Law"; and
WHEREAS, a Public Hearing on the proposed Local Law was duly advertised in the
Southern Dutchess News and the Poughkeepsie Journal as required by law; and
WHEREAS, a Public Hearing was held on April 13, 2026 and all parties in attendance were
permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or any
part thereof; and
WHEREAS, the Town Board has determined that the Proposed Action is an action for
which there are no other Involved Agencies and that the Town Board is therefore, by default, the
Lead Agency for this action; and
WHEREAS, said Local Law has been on the desks of the members of the Town Board of
the Town of Wappinger for at least ten (7) days prior to the adoption of this resolution.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The Town Board hereby adopts and incorporates the recitations and statements set
forth above as if fully set forth and resolved herein.
2. The Town Board, after due deliberation, finds that it is in the best interest of the
Town to adopt said Local Law, and the Town Board hereby adopts Local Law No. 8
of 2026, a copy of which is attached hereto and made a part of this Resolution; and
3. The Town Clerk is directed to enter said Local Law in the minutes of this meeting into the
Local Law book for the Town of Wappinger and to give due notice of the adoption of said Local

A Local Law Declaring That the Instrument Filed with the New York Secretary of State as Q
Local Law No. 1 of 2020 of the Town of Wappinger Is Void Ab Initio for Failure to Comply o
with the Requirements of the Municipal Home Rule Law
BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section 1: Title
This Local Law shall be known and cited as "A Local Law Declaring Local Law No. 1 of
2020 of the Town of Wappinger Void Ab Initio."
Section 2: Legislative Findings and Recitations
The Town Board hereby finds and declares as follows:
A. On December 9, 2019, the Town Board unanimously adopted Resolution No. RES -2019-
213, an introductory resolution titled "Resolution Introducing Local Law No. 1 of 2020
Which Would Amend Chapter 240, Zoning, Of The Town Code With Respect To The
Addition Of `Liquid Propane Storage Facilities' As A New Special Permit Use In The
Highway Business And Airport Industry Zoning Districts." That resolution did not adopt
any local law. Its operative effect was limited to: (i) introducing the proposed Local Law
for consideration; (ii) scheduling a public hearing thereon for 7:00 PM on January 13, 2020;
(iii) directing the Town Clerk to publish notice of the public hearing in the Southern
Dutchess News and the Poughkeepsie Journal; and (iv) directing distribution of copies to
the Town Planning Board and the Dutchess County Department of Planning and
Development for their advisory review. Resolution No. RES -2019-213 was an introductory
resolution only and conferred no authority to adopt a local law.
B. On January 13, 2020, the Town Board convened a Regular Meeting at Town Hall, 20
Middlebush Road, Wappingers Falls, New York, at 7:00 PM. A public hearing on the
Proposed Local Law had been duly noticed. The public hearing was opened at that meeting.
The public hearing was not completed and was not closed; it was adj ourned pending further
proceedings before the Town of Wappinger Planning Board in connection with the
Downey Energy Liquid Propane Facility project. No completed public hearing was held
before the Town Board as required by Municipal Home Rule Law § 20(5).
C. At the same January 13, 2020 Regular Meeting, the resolution to adopt the Proposed Local
Law was tabled. The official record of the Town of Wappinger reflects the following result
for Resolution No. RES -2020-37:

Resolution No. RES -2020-37 was tabled by a unanimous vote of the members present. It
was not passed. No final vote on passage of the Proposed Local Law was ever taken by the
Town Board as required by Municipal Home Rule Law § 20(1). No determination was
made under the State Environmental Quality Review Act was made at our prior to the
meeting on the action.
D. Despite the foregoing, an instrument denominated "Local Law No. 1 of 2020" was
thereafter submitted to and filed with the New York Department of State, Division of
Corporations, State Records and Uniform Commercial Code, and was stamped as received
on or about February 3, 2020. The instrument as filed was accompanied by a cover
document denominated Resolution No. RES -2020-37, which incorrectly recited a result of
"ADOPTED [UNANIMOUS]" and listed the following ayes: Richard Thurston, William
H. Beale, Christopher Phillips, Al Casella, with Angela Bettina listed as absent. That
recitation is contrary to the official record in every material respect: the resolution was
tabled, not adopted. The instrument filed with the Secretary of State therefore contains
incorrect recitations of the vote and result and does not constitute a valid record of
enactment.
E. Municipal Home Rule Law § 20(5) provides that no local law shall be passed by the
legislative body of a town until a public hearing thereon has been had before such body.
That mandatory condition precedent was not satisfied. The public hearing before the Town
Board on January 13, 2020 was opened but was adjourned without being closed or
completed. No completed public hearing was ever held before the Town Board.
F. Municipal Home Rule Law § 20(1) requires that on the final passage of a local law the
question shall be taken by ayes and noes, and the names of the members present and their
votes shall be entered in the record, journal, or minutes of proceedings of the legislative
body. No vote on final passage of the Proposed Local Law was ever taken. Resolution No.
RES -2020-37, the only resolution presented for that purpose, was tabled unanimously.
G. The filing with the Secretary of State of a purported local law that was never enacted in
compliance with the mandatory requirements of Municipal Home Rule Law § 20 does not
create a valid, binding, or effective local law. A purported enactment that lacks both the
statutorily required completed public hearing and the required vote on final passage is void
ab initio it has no legal force or effect from inception and confers no rights upon any
person or entity. Towns derive their legislative authority solely by grant and may not act
except in strict conformance with applicable procedure; action taken in the absence of such
compliance is ultra vires and a nullity.

H. Because the instrument filed as Local Law No. 1 of 2020 was never enacted and has no N
legal existence, no repeal is necessary or appropriate, as one cannot repeal a nullity. The N
purpose of this Local Law is to formally memorialize that legal status on the public record °
and to direct corrective notice to the Secretary of State.
Section 3: Declaration
The instrument filed with the New York Secretary of State on or about February 3, 2020
as Local Law No. 1 of 2020 of the Town of Wappinger is hereby declared to be void ab initio and
of no legal force or effect from the date of such filing. The instrument purported to amend Chapter
240, Zoning, of the Code of the Town of Wappinger. It did not do so. Chapter 240, Zoning, of the
Code of the Town of Wappinger was not amended by that instrument and remains in the form in
effect immediately prior to January 13, 2020, as if the Proposed Local Law had never been
introduced.
Section 4: Direction to Town Clerk
The Town Clerk is hereby directed to:
(a). Enter this Local Law in the minutes and Local Law book of the Town of Wappinger;
(b).File this Local Law with the Secretary of State of the State of New York pursuant to
Municipal Home Rule Law § 27;
(c). Transmit written notice to the New York Department of State, Division of Corporations,
State Records and Uniform Commercial Code, advising that the instrument filed as Local
Law No. 1 of 2020 of the Town of Wappinger was erroneously filed, was never duly
enacted, and has been declared void ab initio by this Local Law; and
(d). Take such additional steps as may be necessary or appropriate to cause the public records
of the Town and the State to reflect the legal nullity of the prior filing.
Section 5: Ratification, Readontion and Confirmation
Except as specifically addressed herein, the Code of the Town of Wappinger as previously
adopted and amended shall remain in full force and effect and is otherwise ratified, readopted and
confirmed.
Section 6: Separability a

The provisions of this Local Law are separable and if any provision, clause, sentence, a
subsection, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any CD
person or circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability, shall o
not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or parts
of this Local Law or their application to other persons or circumstances. It is hereby declared to
be the legislative intent of the Town Board of the Town of Wappinger that this Local Law would
have been adopted if such illegal, invalid or unconstitutional provision, clause, sentence, 0
subsection, word or part had not been included therein, and if such person or circumstance to which a>
the Local Law or part thereof is held inapplicable had been specifically exempt therefrom.
Section 7: Effective Date
This Local Law shall take effect immediately upon filing with the Secretary of State as
provided by the Municipal Home Rule Law.

WHEREAS, the official record of the Town of Wappinger reflects that Resolution No.
RES -2020-37, the resolution that would have adopted the Proposed Local Law, was TABLED
UNANIMOUSLY at the January 13, 2020 Regular Meeting of the Town Board, and was never
brought back for a vote; and
WHEREAS, the Town Board finds that corrective notice to the Department of State is
warranted to prevent any potential reliance upon on or application of the void instrument; now
therefore
BE IT RESOLVED, that the Town Clerk is authorized and directed to transmit to the New York
Department of State a written notice, in such form as the Town Attorney may approve, advising
that the filing denominated Local Law No. 1 of 2020 of the Town of Wappinger was erroneously
submitted, was accompanied by a falsified vote record, and that the Town Board has, by Local
Law No. 7 of 2026, declared said instrument void ab initio and of no legal force or effect.

Resolution Appointing Seasonal Laborers In The Buildings
And Grounds Department
WHEREAS, the Town Board has determined that hiring seasonal employees in the Buildings and
Grounds Department to assist with the repairs and maintenance of Town owned parks and facilities
is necessary, and
WHEREAS, the Rules of the Dutchess County Department of Human Resources authorizes the
appointment of employees by the Town on a seasonal basis, and
WHEREAS, Town Supervisor Joseph D. Cavaccini and Supervisor of Buildings and Grounds
Salvatore Messale recommend the appointment of five employees as full time seasonal Laborers in
the Buildings and Grounds Department, and

Resolution Declaring SEQRA Negative Declaration On
Proposed Improvements To Wildwood Wastewater Trea
WHEREAS, the Town of Wappinger has proposed implementing design changes to the Wildwood
Wastewater Treatment Plant (hereinafter referred to as WWTP); and
WHEREAS, recommended improvements include the relocation of the existing effluent discharge
outfall, which was the most cost-effective choice and will extend the useful service of the existing WWTP
and will be pursued by the Town Board; and
WHEREAS, pursuant to 6 NYCRR 617.6 the Town Board sought to be established as Lead Agency as
part of a coordinated review of this action with the identified Involved and Interested Agencies by
Resolution 2026-67; and
WHEREAS, the Town Board authorized the Secretary to the Town Supervisor Kaitlyn Aboshanab to
send out a Notice of Intent to all Involved and Interested Agencies on March 4, 2026, and
WHEREAS, the Town Board received no objections to their request to serve as Lead Agency; and
WHEREAS, the Town Board has classified this action as an Unlisted Action and prepared a Short Form
Environmental Assessment Form (SEAF) Part 1, 2, and 3 for the proposed project.
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Wappinger duly
convened as follows:
The Town Board, upon due deliberation of SFEAF Parts 1, 2, and 3 finds that the proposed action
will not result in any significant adverse environmental effects; and
The Town Board of the Town of Wappinger as Lead Agency, hereby issues a Negative Declaration
pursuant to the requirements of the SEQRA and authorizes Town Supervisor Joseph D. Cavaccini to sign

DESIGNATION OF RESTRICTED HIGHWAY
Pursuant to Section 104a of the Highway Law the following described highway: PMI Paving:
Segments of Routes 376 and 113 in the Towns of Poughkeepsie, Lagrange., Wappingers, and
East Fishkill, Dutchess County, which is being performed under Contract No. D265714 is hereby
designated as a Restricted Highway. The restriction will be an additional one mile in each
direction. The locations are shown on the attached location maps and contract limits from RM376-
8201-1023 to RM376-8201-1078, RM376-8201-1081 to RM376-8201-1123, and RM113-8201-
1030 to RM113 8201 1031. Roadway and sidewalk segments in each direction is hereby declared
as Restricted Highway until the operation is completed, County road segments for signage and
portable variable message board locations are inclusive of this Restricted Highway. The
Designation of Restricted Highway shall expire 30 days after completion of project.
Pursuant to Section 1625 of the Vehicle and Traffic Law all movement of vehicles,
persons, or animals on such highway is hereby restricted and regulated in accordance with the
determination of the Commissioner of Transportation as evidenced by posted signs, signals, or
barriers placed along said highway and/or by direction by an authorized representative of the
Commissioner of Transportation.
Any Action taken by the Commissioner of Transportation pursuant to Section 1625 of the
Vehicle and Traffic Law shall supersede any other provisions of the Vehicle and Traffic Law where
inconsistent or in conflict with respect to the following enumerated subjects:
1. Establishment of maximum and minimum speed limits at which vehicles may
proceed along any such restricted highway.
2. Weights and dimensions of vehicles.
3. Use of such restricted highway by pedestrians, equestrians, and animals.
4. Parking, standing, stopping, and backing of vehicles.
5. Control of persons and equipment engaged in work on such highway.
The provisions of the Vehicle and Traffic Law with respect to registration shall not apply
to vehicles and equipment engaged in work on such restricted highways.
. When used on such restricted highways, all traffic control devices shall be considered as
official traffic control devices and shall conform to the manual and specifications for a uniform
system of traffic control devices adopted by the Department of Transportation.

Section 155.1 Definition. The term restricted highway when used in this part: shall mean
any. highway or portion thereof under construction or reconstruction under the supervision. of the
Comrrmissione.r of Transportation. and which is designated. by the Commissioner as a restricted
highway pursuant to Section 104a of. the. Highway Law.
155.2 Traffic control devices. Unless otherwise posted, traffic control devices used on
restricted highways shall conform to the requirements of the. Vehicle and Traffic Law. .
155.3.Flagmen. Operators of vehicles on restricted highways shall follow the directions
of any flagman with respect to movement of `such vehicles,
155.4 Control of persons and equipment. Construction personnel and equipment

engaged in work on such restricted highway ,shall be afforded the widest latitude in operating

within the restricted highway consistent with the safety of the traveling public. This shall include,
but not be limited to, the crossing of the highway and the mall; the shutting -off of lanes of travel

Part to adequately protect the public at locations where emergency. or. unusual conditions,occur
or exist as a result of the construction or reconstruction on a restricted highway,. These alterations
or modifications shall have the same force and effect as though they were specifically set forth in
this Part and shall remain in force until the condition is considered by the Commissioner to be
safe and the erected signs, signals, or other traffic control devices have been officially removed.
155.7 Effective date. The provisions of this Part shall be effective with respect to a
specific restricted highway from the date :the highway is designated a restricted highway by an
official designation of the Commissioner of Transportation. The provisions of this Part shall also
be effective with respect to all restricted. highways which have theretofore.' been designated as
restricted highways by the Commissioner of Transportation and on which the restriction has not
been removed by notice. of cancellation issued by the Commissioner ofTransportation. ;

The undersigned, Frances Houghton, Chair of the Election, Paolina Lita and Anne Marie
Pantaleo, Inspectors and Ballot Clerks, DO HEREBY CERTIFY AS FOLLOWS:
(1) That each of us is a resident elector of the Hughsonville Fire District in the Town of
Wappinger, Dutchess County, New York, and that pursuant to a resolution adopted by the Board of
Fire Commissioners of the Fire District on February 25, 2026, we were appointed to the offices set

(2) Prior to the opening of the polls, each ballot to be used at the special election had
been examined.
(3) After the polls had closed for said election, we immediately canvassed the ballots
cast. Inspection of such ballots disclosed the following results:

(4) Upon the completion of such canvass, the Chair of the election publicly announced
the result thereof.
(5) A true, correct and complete copy of the official ballot used at said special election is

(6) On April 7, 2026 a meeting of the Inspectors of Election was held. At said meeting
a register of all persons entitled to vote in the election was prepared containing the names of all
persons residing in the Fire District and qualified to vote in said election whose names were on
the registration list certified and supplied to the Fire District by the Dutchess County Board of
Elections as of a date twenty-three days before the date of said election. All of the votes described
above were of voters whose names appear on the register prepared at such meeting.

Dear Supervisor Joseph D. Cavaccini and members of the Board:
This letter is formal request for the subject property to be added to the United Wappinger Sewer District.
The owner of the property is looking to expand the existing uses and is seeking sewer service for an anticipated
flow between 10,000 and 15,000 gallons per day.
Connection of the property to existing Town of Wappinger sewer infrastructure would require installation of
a sewage pump station and a 3 inch diameter forcemain along Myers Corners Road to the existing Town pump
station located near the westerly intersection of Old Myers Corners Road and Myers Corners Road.
The owner is willing to size the pump station to accommodate potential future connection of surrounding
properties and potential future flows but would be looking to the Town to assist with the cost differential between
the size required for the property and the size required for the future flows.
The Town has requested an 8 inch forcemain be installed to accommodate future flows. The owner is
willing to install a larger forcemain but is looking to the Town to assist with the cost differential between the size
required for the property and the size required for the future flows. The larger forcemain would also need to be
reviewed and approved by the Dutchess County Department of Health.

Proposed Action
WHEREAS, the Town of Wappinger Town Board (hereafter Town Board), believes that changes to the
Official Zoning Map are necessary to provide for the quality layout and management of future residential
land use and development; and
WHEREAS, the Town Board, therefore, proposes to downzone specified areas to R -5A: One -Family
Residence (5 Acre) District that are currently in R-20, R20/40, R40, R40/80 & R-80 Zones, with this
downzoning explicitly described in proposes Local Law : Zoning Map Amendment to Add Identified
Areas to the R -5A: One -Family Residence (5 Acre) Zone covering xx parcels and xx acres in order to
assist providing for orderly growth; and
WHEREAS, the adoption of the 2025 Plan Updates and Zoning Amendments is an Unlisted action
based on a review of SEQRA, NYCRR 617.4 - Type I Actions, and 617.5 - Type II Actions; and
WHEREAS, since the Town Board is the only entity that can legislatively adopt this Zoning Map
Amendment, the Town Board seeks to serve as the Lead Agency for this proposed action; and
WHEREAS, the Town Board prepared and reviewed Part 1 of a Full Environmental Assessment Form
("FEAF") as part of advancing review of this proposed action; and
WHEREAS, the proposed action would not involve a federal agency; and
WHEREAS, the Town Board is required to refer Zoning amendments to the Town of Wappinger
Planning Board for its report thereon per Town Zoning §240-112.13 Advisory Report by Planning Board;
and
WHEREAS, the Town Board is required to provide a statement on the relationship of this proposed
zoning amendment with Dutchess County Greenway Connections per Zoning §240-112.A.3 Greenway
Connections.
NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Wappinger in regular
session duly convened as follows:
The Town Board of the Town of Wappinger hereby determines that this Zoning Map
change is an Unlisted Action under SEQRA; and
2. The Town Board hereby declares its interest and intent to serve as the Lead Agency
pursuant to SEQRA and its implementing regulations at 6 NYCRR §617.6 (b)(2)(1), with
respect to the proposed action to add areas to amend the Official Zoning Map by adding
additional areas to the R -5A Zoning District, and the Town Board hereby directs the
Town Clerk to circulate a notice to the identified involved and interested agencies on this

RE: Greenway Consistency - R -5A: One -Family Residence (5 Acre) Zoning Map Amendment
Per Zoning Article VIII. Amendments, §240-112(A)(3) Greenway Connections, this memo reviews and considers
the statement of land -use policies, principles, and guidelines in Dutchess County Compact's Greenway
Connections. Overall, this residential minimum lot size increase is consistent with all five (5) Greenway Compact
goals, most importantly because it aids natural and cultural resource protection, potential public access, trails,
and potential agricultural economic development. Ultimately, this zoning density reduction can help avoid
sprawl and reinforce a coherent pattern of open space in relation to priority growth areas and primary centers.
Considering the 'Purposes' of town zoning, this rezoning amendment guides development in accordance with
the Comprehensive Plan as it promotes safety from flood and other dangers, assists patterns that can prevent
pollution of watercourses and wetlands, helps to safeguard the water table, and encourages sound natural
resource management. The amendment will also aid the preservation of the natural beauty of the physiography
of the Town, protect against obtrusive land use, and ensure appropriate development with regard to such
elements. Extending into the Greenway Guide and notions for Centers and Greenspaces, this action will help
to reduce sprawl and establish an open space core in central sections of Town.
Lowering the base zoning density in specific areas will assist with calibrating the Town's land use laws. The
August 2025 zoning amendments provides for more predictable development. Now, this targeted reduction in
permitted residential density will align with the Greenway Benefit of environmental enhancement by advancing
environmental protection and generally, though not directly, facilitating contiguous open space "Greenways
[that] create a conscious intermingling of the natural and human landscape...", as contemplated in Greenway
Connections Sourcebook, page 14.
The 2025 Comprehensive Plan Update sets an objective to provide water and sewer infrastructure planning.
This downzoning aligns with the notion of planning for public infrastructure, as described in Sourcebook page
41, 'Coordinating Development with Central Utilities'. By scaling -back density, The Town of Wappinger will be
protected from overdevelopment at the same time planning occurs to establish policies that encourage
development in the most appropriate areas. That planning process will involve identifying where and how to
provide cost-effective growth, while also upgrading the development framework so there is protection of
natural features than would otherwise be taken for granted and impacted without adequate management
planning. The locations of this rezoning are not in a Primary Center identified in the Sourcebook's 'Settlement

places targeted are overlain by valued open space and natural resources.
Based on this rationale, it is recommended that the Town Board find that the planned residential minimum lot
size increase is consistent with the land use policies, principles, and guidelines contained in Greenway
Connections to the extent practical and appropriate. The Town is embarking on planning to more fully identify
priority growth areas and is using an approach to analyze, plan, and implement central water and wastewater
in existing centers and prioritized locations. The zone change will enable the layout of a development pattern
that fits with and will enhance Wappinger's natural landscape and "greenway" simultaneous with the effort to
protect the municipality from overdevelopment.

Wappinger To Regulate Parking On Myers Corners Road
WHEREAS, a proposed Local Law entitled "A Local Law Amending Chapter 230-46, 47, and
48 of the Town Code Limiting Parking on Myers Corners Road" has been introduced before
the Town Board of the Town of Wappinger; and
WHEREAS, the purpose of said Local Law is to prohibit parking, stopping, and standing on
Myers Corners Road from its westernmost intersection with Old Myers Corners Road to its
intersection with U.S. Route 9; and
WHEREAS, the Town Board has been advised by the Wappingers Central School District
and the Dutchess County Sheriff's Office that vehicles parked along Myers Corners Road
have created unsafe conditions by restricting traffic flow, limiting pedestrian access, and
increasing the risk of accidents; and
WHEREAS, the Town Board finds that prohibiting parking, stopping, and standing along this
corridor will alleviate congestion and improve roadway safety; and
WHEREAS, the Town Board further finds that the enactment of this Local Law is in the best
interest of the public health, safety, and welfare of the residents of the Town of Wappinger;
and
WHEREAS, the Town Board is required to conduct a public hearing prior to the adoption of
said Local Law;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger will
hold a Public Hearing on the proposed Local Law at 7:00 p.m. on the 27 day of April, 2026,
at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, or via such other means as
may be designated by the Town Board; and
BE IT FURTHER RESOLVED, that all persons interested in the subject matter thereof shall
be heard at such time and place; and
BE IT FURTHER RESOLVED, that the Town Clerk is hereby authorized and directed to cause
a notice of such Public Hearing to be published in the official newspaper of the Town in

Section 1. Title
This Local Law shall be known and cited as "A Local Law Amending Chapter 230-46, 47, and 48 Of The Town Code Limiting Parking
On Myers Corners Road"
Section 2. Legislative Intent
At the request of the Wappingers Central School District and Dutchess County Sheriff's Office, the Town Board believes that it is
reasonable and appropriate to amend Chapter 230-46, 230-47, 230-48 of the Town Code to prohibit parking, stopping, and stand-
ing on Myers Corners Road from its westernmost intersection of Old Myers Corners Road and Myers Corners Road to where it
meets US Route 9. This is due to the unsafe situations that have presented themselves when motorists are parked along side the
roadway limiting traffic flows, pedestrian access, and potentially causing accidents.
Preventing parking, stopping, and standing on Myers Corners Road will limit the congestion of the roadway and improve traffic
flow. This local law is determined to be an exercise of the police powers of the Town to protect the public health, safety and wel-
fare of its residents.
Section 3. Amendments to Chapter 230-46, 47, 48.
