Ray of 5 skytop drive addressed Cranberry liked the idea and would like to see more open space.
Marcy Wagan Old troy road appeared to support the purchase this property. She pointed out that
quality of life referrs to open spaces , parks and environmental concerns.
Linda Ibrahim Sherwood Heights agrred that there was too much over development and
supported the purchase. Leaving it developers would add more congestion and impact water and
sewer which has a strained capacity. She emphasized that the cost to the town out weighs the tax
revenue.
Mary Sager sports museam member added her support.
Nicole 347 All angels rd cheerleading coach supported the park to allow the school students to
run through a park rather than on highway roads.
Rita del valley 12 orchard dr. supported the purchase.
30 Carmel heights said thank you for considering this.
John Tylickey spoke in favor of open spaces God said buy land theyre not making more of it.
Sike lives near it and putting a development there would destroy it.

quality of life should not be destroyed.
Mark van kirk 125 Meyers . This was farming community not a housing community. Our
infrastrucure cannot afford this.
David Barr member of planning board should preserve any green spaces we have left.
Kevin Giles County Legislator is for the proposal to buy the cranberry site. Daily destination to
walk and play
Marco Periketos does all they can do to stop the over development. This is one chance to stop it.

Resolution Introducing Local Law No. 7 Of 2026 Which Would Declare That The
Instrument Filed With The New York Secretary Of State As Local Law No. 1 Of 2020 Of
The Town Of Wappinger Is Void Ab Initio For Failure To Comply With The
Requirements Of The Municipal Home Rule Law
WHEREAS, the Town Board is aware that an instrument denominated "Local Law No. 1
of 2020" was filed with the New York Secretary of State on or about February 3, 2020,
purporting to amend Chapter 240, Zoning, of the Town Code to add `Liquid Propane Storage
Facilities' as a new Special Permit Use in the Highway Business (HB) and Airport Industry (AI)
Zoning Districts in connection with the Downey Energy Liquid Propane Facility project (the
"Prior Filing"); and
WHEREAS, the Town Board has determined that the Prior Filing was never duly
enacted, in that: (i) no completed public hearing was held before the Town Board as required by
Municipal Home Rule Law § 20(5) - the public hearing noticed for January 13, 2020 was opened

but adjourned without being closed or completed; and (ii) no final vote on passage of the
proposed local law was ever taken as required by Municipal Home Rule Law § 20(1) -
Resolution No. RES -2020-37, the only resolution presented for that purpose, was tabled
unanimously at the January 13, 2020 Regular Meeting; and
WHEREAS, the Town Board has further determined that the Prior Filing was
accompanied by a cover document, denominated Resolution No. RES -2020-37, which
incorrectly recited a result of "ADOPTED [UNANIMOUS]" contrary to the official record of the
Town, which reflects that said resolution was TABLED UNANIMOUSLY and was never
passed; and
WHEREAS, a local law declaring the Prior Filing void ab initio and directing corrective
notice to the Secretary of State (the "Proposed Local Law") has been prepared and is annexed
hereto and has been laid upon the desk of each member of the Board; and
WHEREAS, for the purposes of the New York State Environmental Quality Review Act
(Article 8 of the Environmental Conservation Law, Part 617 NYCRR, commonly known as
"SEQRA"), the Town Board has determined that the Proposed Local Law constitutes a
UNLISTED ACTION , consists solely of a legislative declaration that a prior filing was
procedurally void and the Town Board hereby declares itself lead agency for the SEQRA review
process; and
WHEREAS, a Public Hearing on the Proposed Local Law is required pursuant to
Municipal Home Rule Law § 20(5) prior to final passage; now therefore
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The Town Board hereby adopts and incorporates the recitations and statements set forth
above as if fully set forth and resolved herein.
2. The Town Board hereby introduces for consideration of its adoption proposed Local Law
No. of 20 in the form annexed hereto.
3. The Town Board hereby schedules a Public Hearing regarding the adoption of the
annexed Proposed Local Law for 7:00 PM on the day of , 20 , at
Town Hall, 20 Middlebush Road, Wappingers Falls, New York, and the Town Clerk is
hereby directed to post the notice of the Public Hearing in the form annexed hereto and to
publish same in the Southern Dutchess News and the Poughkeepsie Journal not less than
ten (10) days prior to said Public Hearing date.
4. The Town Board hereby directs the Town Clerk to act as follows with respect to the
Proposed Local Law:
a. To serve a copy of this resolution and the annexed Proposed Local Law upon the
municipal clerk of each abutting municipality not less than ten (10) days prior to
said public hearing;
b. To serve a copy of this resolution and the annexed Proposed Local Law upon the
Dutchess County Department of Planning and Development for advisory review

in accordance with Section 239-m of the New York State General Municipal Law;
and
C. To distribute a copy of this resolution and the annexed Proposed Local Law to the Town

2. The Town Board acknowledges and regretfully accepts the resignation of Daniel Franks as

WHEREAS, the Town of Wappinger recognizes the countless contributions women have
made throughout history in shaping our community, state, and nation; and
WHEREAS, women have played a vital role in advancing progress in all fields, including
government, education, business, science, the arts, and public service; and
WHEREAS, Women's History Month is celebrated annually in March to honor the
achievements, leadership, and resilience of women and to promote the continued pursuit
of equality and opportunity; and
WHEREAS, the Town of Wappinger is proud to acknowledge and celebrate the
accomplishments of the women who have strengthened our community through their
leadership, service, and dedication; and
WHEREAS, it is important to recognize both the historic and ongoing contributions of
women, while inspiring future generations to continue breaking barriers and building a
more inclusive society;

WHEREAS, the Town of Wappinger recognizes the importance of arts education in fostering
creativity, critical thinking, and cultural awareness amongyoung people; and
WHEREAS, participation in the visual arts enhances students' academic performance and
supports the development of problem -solving skills, self-expression, and confidence; and

creativity; and
WHEREAS, celebrating Youth Art Month provides an opportunity to recognize the artistic

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger does
hereby proclaim the month of March as Youth Art Month in the Town of Wappinger; and

RESOLUTION: 2026-81
Resolution Authorizing 2025 Budget Amendment
WHEREAS, the Town Board of the Town of Wappinger adopted the 2025 Town Budget; and
WHEREAS, from time to time it is necessary to amend the Town Budget to properly account
for revenues received and expenditures incurred during the fiscal year; and
WHEREAS, the Town Comptroller has reviewed the financial records and recommends
certain amendments to reconcile revenues and expenditures across various Town funds.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger hereby
authorizes amendments to the 2025 Town Budget as detailed in Schedule A, attached
hereto and made part of this resolution; and
BE IT FURTHER RESOLVED, that the Town Comptroller is hereby authorized and directed to
make the necessary budgetary and journal entry adjustments to the Town's financial
records in accordance with Schedule A.

RESOLUTION: 2026-92
Resolution Adopting Local Law Amending Chapter 240-36.3 Of The Town Code Entitled
"Solar Energy Systems"
WHEREAS, the Town Board has considered the adoption of Local Law Amending Chapter
240-36.3 Of The Town Code Entitled "Solar Energy Systems"; and
WHEREAS, a Public Hearing on the proposed Local Law was duly advertised in the
Southern Dutchess News and the Poughkeepsie Journal as required by law; and
WHEREAS, a Public Hearing was held on March 23, 2026 and all parties in attendance
were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or
any part thereof; and
WHEREAS, the Town Board has determined that the Proposed Action is an action for
which there are no other Involved Agencies and that the Town Board is therefore, by default, the
Lead Agency for this action; and
WHEREAS, said Local Law has been on the desks of the members of the Town Board of
the Town of Wappinger for at least ten (7) days prior to the adoption of this resolution.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The Town Board hereby adopts and incorporates the recitations and statements set
forth above as if fully set forth and resolved herein.
2. The Town Board, after due deliberation, finds that it is in the best interest of the
Town to adopt said Local Law, and the Town Board hereby adopts Local Law No. 7
of 2026, a copy of which is attached hereto and made a part of this Resolution; and
3. The Town Clerk is directed to enter said Local Law in the minutes of this meeting
into the Local Law book for the Town of Wappinger and to give due notice of the
adoption of said Local Law to the Secretary of State of New York.

RESOLUTION: 2026-93
Resolution Authorizing Town Supervisor To Enter Into Letter of Intent To Purchase 326
Acres Of Land,
WHEREAS, Wappingers RE LLC owns 326.34 acres of vacant land as shown on the
Town of Wappinger Tax Map as 135689-6158-04-951582 (the "Premises") and the Town of
Wappinger has negotiated for the purchase of the Premises by the Town for Two Million Seven
Hundred Thousand Dollars; and
WHEREAS, the Town Board wishes to authorize the purchase of the Premises for Town
purposes, pursuant to and in accordance with the provisions of Section 220 of the Town Law of
the State of New York, subject to the permissive referendum requirements of Town law Sections
90 and 91; and
WHEREAS, the Town Board wishes to authorize Town Supervisor Joseph D. Cavaccini
to sign a letter of intent for the purchase, which includes a downpayment in the amount of one
hundred and thirty five thousand dollars ($135,000), with contingencies for (i) compliance with
said permissive referendum requirements, (ii) clean title, and (iii) all standard vacant land
contract provisions to be incorporated into a contract upon the finalizing of any grant funding for
the Premises; and
WHEREAS, the Town Board further authorizes Town Supervisor Joseph D. Cavaccini
to apply for any and all grants that may pertain to the purchase and use of the Premises for Town
purposes.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of
Wappinger hereby authorizes the purchase of the premises and the entering into a letter of intent
for such purchase subject to the contingencies noted above, with a formal contract to be entered
upon completion of any necessary requirements in obtaining grant funding; and
BE IT FURTHER RESOLVED, that Town Supervisor Joseph D. Cavaccini is
authorized to solicit bids and otherwise contract for the performance of such tests, reports and
investigations as may be deemed necessary and prudent in order to determine the suitability of
the Premises, with our without renovations, for one or more Town purposes, subject to
compliance with the Town's Procurement policies and as otherwise required by law; and
BE IT FURTHER RESOLVED, that, pursuant to Town Law Sections 90 and 91, within ten
(10) days after the effective date of this Resolution, the Town Clerk, shall post and publish a
notice in the same manner as provided for notice of a special election, which shall (i) set forth
the date of adoption of this resolution; (ii) contain an abstract of this resolution concisely setting
forth the purpose and effect thereof, (iii) specify that this resolution was adopted subject to
permissive referendum; and (iv) publish such notice in the official Town newspaper having
general circulation in the Town, and the Town Clerk shall also post or cause to be posted on the
sign board of the Town a copy of such notice.

RESOLUTION: 2026-94
Resolution to Apply For Funding 2025 NYSDEC Open Space Conservation Grant
Program (Oscgp) "Cranberry Hills Property Acquisition"
WHEREAS, the Town of Wappinger, desires to apply for $3.5 million in financial assistance through the
2025 DEC Open Space Conservation Grant Program, performance payments grant, involving interim
payment from DEC for the Town to use as upfront land and closing costs and a contract term of three
years; and
WHEREAS, the bid proposes funding for acquisition of land to for the purposes of protection from
development and for public benefit of all New Yorkers; and
WHEREAS, the property located at, and known as, the Cranberry Hills parcel is available for fee title
acquisition, and the landowner wishes to sell the land to the municipality for the purpose of establishing a
community forest; and
WHEREAS, the DEC will hold 10% of the total land cost in retainage at the closing until recorded deed
and final title insurance is received by DEC; and
NOW THEREFORE BE IT RESOLVED, that the Town Board of the Town of Wappinger approves and
endorses the bid for the 2025 DEC Open Space Conservation Grant Program and, recognizing this is a
performance-based payments grant that may require minimum amounts of funding upfront, an order of
operation for closing requirements and that the Town understands that if the total project funds exceed the
DEC funds, the Town will commit to utilizing general fund balance and/or existing capital reserve funds to
cover projectoverages; and
BE IT FURTHER RESOLVED, to the extent all or any actions hereby authorized have been executed
and/or performed by the Supervisor, all are hereby ratified and confirmed and this Resolution take effect
immediately.

To Establish The Type Of Action And Declare Intent For The Town Board To Serve As
The Lead Agency
WHEREAS, the Town Board proposes to purchase +/-326 acres of forested open space and wetlands in
Cranberry Hills and conserve this property that is accessed from Quaker Road in the Town of Wappinger,
Tax ID 9 135689 6158-04-951382-0000, in order to preserve natural community character and assist
orderly growth; and
WHEREAS, the action for the Town Board to purchase this property is a Type 1 action based on a
review of the New York State Environmental Quality Review Act (SEQRA), NYCRR 617.4 - Type I
Actions, specifically per subsection 617.4.(b.)(4), as this proposal would encompass the acquisition,
sale, lease, annexation or other transfer of 100 or more contiguous acres of land by a State or local
agency; and
WHEREAS, the Town Board is the only entity that can legislatively enact the purchase of this property
by the Town, the Town Board seeks to serve as the Lead Agency for this proposed action; and
WHEREAS, the Town Board prepared and reviewed Part 1 of a Full Environmental Assessment Form
("FEAF") as part of advancing the review of this proposed action; and
WHEREAS, the proposed action would not involve a federal agency; and
WHEREAS, conserving this Cranberry Hills property presents an opportunity to ensure future
development responds to and respects existing areas of important natural landscape features, as
discussed under the `Community Appearance & Character' section of the 2010 Comprehensive Plan,
which also identifies the same parcel as environmentally sensitive, noting it has been the subject of a
variety of development applications, prompting the Town Board to act under a belief there is a
significant and urgent risk of habitat and open space fragmentation if this lot is developed with new
residential housing; and
WHEREAS, in addition to this property's value as habitat and natural open space and its service in
underpinning biodiversity, the proposed action to conserve the property will support community-based
recreation opportunities, including but not limited to nature viewing and hiking; and
WHEREAS, as part of its value as habitat and natural open space, conserving natural cover, including
forests and the substantial wetlands onsite, this action will preserve a natural asset that serves as a storm
buffer, helping to mitigate the potential of flooding downstream from this property;
NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Wappinger in regular
session duly convened as follows:
The Town Board of the Town of Wappinger hereby determines that it is the general
public interest and it authorizes the purchase of +/-326 acres of forested open space and
wetlands in Cranberry Hills with the intent to conserve this property that is accessed from

4. The Town Board hereby declares its interest and intent to serve as the Lead Agency
pursuant to SEQRA and its implementing regulations at 6 NYCRR §617.6 (b)(2)(1), with
respect to the action to purchase +/-326 acres of forested open space and wetlands in
Cranberry Hills and conserve this property, Tax ID 9135689 6158-04-951382-0000, as
open space; and
5. The Town Board of the Town of Wappinger hereby identifies its interest in serving as the
lead agency, and identifies its intent to perform a coordinated review under SEQRA; and
6. The Town Board hereby directs the Town Clerk to circulate a notice to the identified
involved agencies on this action, its classification, and undertaking procedures to
establish the lead agency and perform a coordinated review; and
The Town Board hereby directs the referral of SEQRA documentation for the proposed Cranberry Hills
property acquisition to the New York State Department of Environmental Conservation for review and
recommendation.

WHEREAS, the Town Board is aware that an instrument denominated "Local Law No. 1
of 2020" was filed with the New York Secretary of State on or about February 3, 2020,
purporting to amend Chapter 240, Zoning, of the Town Code to add `Liquid Propane Storage
Facilities' as a new Special Permit Use in the Highway Business (HB) and Airport Industry (AI)
Zoning Districts in connection with the Downey Energy Liquid Propane Facility project (the
"Prior Filing"); and
WHEREAS, the Town Board has determined that the Prior Filing was never duly
enacted, in that: (i) no completed public hearing was held before the Town Board as required by
Municipal Home Rule Law § 20(5) - the public hearing noticed for January 13, 2020 was opened
but adjourned without being closed or completed; and (ii) no final vote on passage of the
proposed local law was ever taken as required by Municipal Home Rule Law § 20(1) -
Resolution No. RES -2020-37, the only resolution presented for that purpose, was tabled
unanimously at the January 13, 2020 Regular Meeting; and
WHEREAS, the Town Board has further determined that the Prior Filing was
accompanied by a cover document, denominated Resolution No. RES -2020-37, which
incorrectly recited a result of "ADOPTED [UNANIMOUS]" contrary to the official record of the
Town, which reflects that said resolution was TABLED UNANIMOUSLY and was never
passed; and
WHEREAS, a local law declaring the Prior Filing void ab initio and directing corrective
notice to the Secretary of State (the "Proposed Local Law") has been prepared and is annexed
hereto and has been laid upon the desk of each member of the Board; and
WHEREAS, for the purposes of the New York State Environmental Quality Review Act
(Article 8 of the Environmental Conservation Law, Part 617 NYCRR, commonly known as
"SEQRA"), the Town Board has determined that the Proposed Local Law constitutes a
UNLISTED ACTION , consists solely of a legislative declaration that a prior filing was
procedurally void and the Town Board hereby declares itself lead agency for the SEQRA review
process; and
WHEREAS, a Public Hearing on the Proposed Local Law is required pursuant to
Municipal Home Rule Law § 20(5) prior to final passage; now therefore

1. The Town Board hereby adopts and incorporates the recitations and statements set forth
above as if fully set forth and resolved herein.
2. The Town Board hereby introduces for consideration of its adoption proposed Local Law
No. of 20 in the form annexed hereto.
3. The Town Board hereby schedules a Public Hearing regarding the adoption of the
annexed Proposed Local Law for 7:00 PM on the day of , 20 , at

LOCAL LAW NO. OF THE YEAR
A Local Law Declaring That the Instrument Filed with the New York Secretary of State as
Local Law No. 1 of 2020 of the Town of Wappinger Is Void Ab Initio for Failure to Comply
with the Requirements of the Municipal Home Rule Law
BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section 1: Title
This Local Law shall be known and cited as "A Local Law Declaring Local Law No. 1 of
2020 of the Town of Wappinger Void Ab Initio."
Section 2: Legislative Findings and Recitations
The Town Board hereby finds and declares as follows:
A. On December 9, 2019, the Town Board unanimously adopted Resolution No. RES -2019-
213, an introductory resolution titled "Resolution Introducing Local Law No. 1 of 2020
Which Would Amend Chapter 240, Zoning, Of The Town Code With Respect To The
Addition Of `Liquid Propane Storage Facilities' As A New Special Permit Use In The
Highway Business And Airport Industry Zoning Districts." That resolution did not adopt
any local law. Its operative effect was limited to: (i) introducing the proposed Local Law
for consideration; (ii) scheduling a public hearing thereon for 7:00 PM on January 13, 2020;
(iii) directing the Town Clerk to publish notice of the public hearing in the Southern
Dutchess News and the Poughkeepsie Journal; and (iv) directing distribution of copies to
the Town Planning Board and the Dutchess County Department of Planning and
Development for their advisory review. Resolution No. RES -2019-213 was an introductory
resolution only and conferred no authority to adopt a local law.
B. On January 13, 2020, the Town Board convened a Regular Meeting at Town Hall, 20
Middlebush Road, Wappingers Falls, New York, at 7:00 PM. A public hearing on the
Proposed Local Law had been duly noticed. The public hearing was opened at that meeting.
The public hearing was not completed and was not closed; it was adj ourned pending further
proceedings before the Town of Wappinger Planning Board in connection with the
Downey Energy Liquid Propane Facility project. No completed public hearing was held
before the Town Board as required by Municipal Home Rule Law § 20(5).
C. At the same January 13, 2020 Regular Meeting, the resolution to adopt the Proposed Local
Law was tabled. The official record of the Town of Wappinger reflects the following result
for Resolution No. RES -2020-37:

Resolution No. RES -2020-37 was tabled by a unanimous vote of the members present. It
was not passed. No final vote on passage of the Proposed Local Law was ever taken by the
Town Board as required by Municipal Home Rule Law § 20(1). No determination was
made under the State Environmental Quality Review Act was made at our prior to the
meeting on the action.
D. Despite the foregoing, an instrument denominated "Local Law No. 1 of 2020" was
thereafter submitted to and filed with the New York Department of State, Division of
Corporations, State Records and Uniform Commercial Code, and was stamped as received
on or about February 3, 2020. The instrument as filed was accompanied by a cover
document denominated Resolution No. RES -2020-37, which incorrectly recited a result of
"ADOPTED [UNANIMOUS]" and listed the following ayes: Richard Thurston, William
H. Beale, Christopher Phillips, Al Casella, with Angela Bettina listed as absent. That
recitation is contrary to the official record in every material respect: the resolution was
tabled, not adopted; and the absent member was Heather O'Dell, not Angela Bettina.
Angela Bettina was not a member of the Town Board at the January 13, 2020 meeting. The
instrument filed with the Secretary of State therefore contains incorrect recitations of the
vote and result and does not constitute a valid record of enactment.
E. Municipal Home Rule Law § 20(5) provides that no local law shall be passed by the
legislative body of a town until a public hearing thereon has been had before such body.
That mandatory condition precedent was not satisfied. The public hearing before the Town
Board on January 13, 2020 was opened but was adjourned without being closed or
completed. No completed public hearing was ever held before the Town Board.
F. Municipal Home Rule Law § 20(1) requires that on the final passage of a local law the
question shall be taken by ayes and noes, and the names of the members present and their
votes shall be entered in the record, journal, or minutes of proceedings of the legislative
body. No vote on final passage of the Proposed Local Law was ever taken. Resolution No.
RES -2020-37, the only resolution presented for that purpose, was tabled unanimously.
G. The filing with the Secretary of State of a purported local law that was never enacted in
compliance with the mandatory requirements of Municipal Home Rule Law § 20 does not
create a valid, binding, or effective local law. A purported enactment that lacks both the
statutorily required completed public hearing and the required vote on final passage is void
ab initio it has no legal force or effect from inception and confers no rights upon any
person or entity. Towns derive their legislative authority solely by grant and may not act
except in strict conformance with applicable procedure; action taken in the absence of such
compliance is ultra vires and a nullity.
H. Because the instrument filed as Local Law No. 1 of 2020 was never enacted and has no
legal existence, no repeal is necessary or appropriate, as one cannot repeal a nullity. The
purpose of this Local Law is to formally memorialize that legal status on the public record
and to direct corrective notice to the Secretary of State.
Section 3: Declaration
The instrument filed with the New York Secretary of State on or about February 3, 2020
as Local Law No. 1 of 2020 of the Town of Wappinger is hereby declared to be void ab initio and
of no legal force or effect from the date of such filing. The instrument purported to amend Chapter
240, Zoning, of the Code of the Town of Wappinger. It did not do so. Chapter 240, Zoning, of the
Code of the Town of Wappinger was not amended by that instrument and remains in the form in
effect immediately prior to January 13, 2020, as if the Proposed Local Law had never been
introduced.
Section 4: Direction to Town Clerk
The Town Clerk is hereby directed to:
(a). Enter this Local Law in the minutes and Local Law book of the Town of Wappinger;
(b).File this Local Law with the Secretary of State of the State of New York pursuant to
Municipal Home Rule Law § 27;
(c). Transmit written notice to the New York Department of State, Division of Corporations,
State Records and Uniform Commercial Code, advising that the instrument filed as Local
Law No. 1 of 2020 of the Town of Wappinger was erroneously filed, was never duly
enacted, and has been declared void ab initio by this Local Law; and
(d). Take such additional steps as may be necessary or appropriate to cause the public records
of the Town and the State to reflect the legal nullity of the prior filing.
Section 5: Ratification, Readontion and Confirmation
Except as specifically addressed herein, the Code of the Town of Wappinger as previously
adopted and amended shall remain in full force and effect and is otherwise ratified, readopted and
confirmed.
Section 6: Separability
The provisions of this Local Law are separable and if any provision, clause, sentence,
subsection, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any
person or circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability, shall
not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or parts
of this Local Law or their application to other persons or circumstances. It is hereby declared to
be the legislative intent of the Town Board of the Town of Wappinger that this Local Law would
have been adopted if such illegal, invalid or unconstitutional provision, clause, sentence,
subsection, word or part had not been included therein, and if such person or circumstance to which
the Local Law or part thereof is held inapplicable had been specifically exempt therefrom.
Section 7: Effective Date
This Local Law shall take effect immediately upon filing with the Secretary of State as
provided by the Municipal Home Rule Law.
RESOLUTION DIRECTING THE TOWN CLERK TO NOTIFY THE SECRETARY OF
STATE THAT THE FILING DENOMINATED LOCAL LAW NO. I OF 2020 WAS
ERRONEOUS
WHEREAS, the Town Board has determined, for the reasons set forth in Local Law No.
of , that the instrument filed with the New York Secretary of State on or about February
3, 2020 as Local Law No. 1 of 2020 of the Town of Wappinger was never duly enacted, was
accompanied by a falsified vote record, and is void ab initio; and
WHEREAS, the official record of the Town of Wappinger reflects that Resolution No.
RES -2020-37, the resolution that would have adopted the Proposed Local Law, was TABLED
UNANIMOUSLY at the January 13, 2020 Regular Meeting of the Town Board, and was never
brought back for a vote; and
WHEREAS, the Town Board finds that corrective notice to the Department of State is
warranted to prevent any potential reliance upon on or application of the void instrument; now
therefore
BE IT RESOLVED, that the Town Clerk is authorized and directed to transmit to the New York
Department of State a written notice, in such form as the Town Attorney may approve, advising
that the filing denominated Local Law No. 1 of 2020 of the Town of Wappinger was erroneously

WHEREAS, the Town of Wappinger recognizes the importance of arts education in fostering
creativity, critical thinking, and cultural awareness amongyoung people; and
WHEREAS, participation in the visual arts enhances students' academic performance and
supports the development of problem -solving skills, self-expression, and confidence; and
WHEREAS, Youth Art Month is a national celebration observed each March to emphasize
the value of art education for all children and to encourage public support for quality
school art programs; and
WHEREAS, the Town of Wappinger is proud to support the artistic achievements of its
youth and to acknowledge the dedication of art educators who inspire and nurture student
creativity; and
WHEREAS, celebrating Youth Art Month provides an opportunity to recognize the artistic
talents of students throughout the Town and to promote greater community appreciation
for the arts;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger does
hereby proclaim the month of March as Youth Art Month in the Town of Wappinger; and
BE IT FURTHER RESOLVED, that all residents are encouraged to recognize and support the
artistic endeavors of our youth and to participate in activities that celebrate and promote
the visual arts within our community.

On March 11, 2026, the New York State Department of Environmental Conservation
(DEC) published a Notice of Adoption in the New York State Register and .in the
Environmental Notice Bulletin to amend Parts 616, 650, and 750 of Title 6 of the Official Q
Compilation of Codes, Rules, and. Regulations of the State of New York (6 a
NYCRR). These new regulations add wastewater cybersecurity and related
regulations for New York wastewater treatment facilities. Please share the following
information with anyone in. your municipality who may be impacted and encourage them

On March 26, 2026 the first requirement becomes effective. Under 6 NYCRR 750-2.7(h) M
all State Pollutant. Discharge Elimination System (SPDES) permittees, :both publicly and 9
privately owned, must report all cybersecurity incidents to DEC within 24 -hours of N
becoming aware of the incident, Please refer to the attached flyer entitled "How to
Report a Wastewater Cybersecur'ity Incident to DEC" for more details.
6 NYCRR 650.8 and 650.12 require that wastewater treatment plant operators, certified
in accordance with Part 650, complete a minimum number of training hours on the .topic
of cybersecurity to renew their certification every five years.
Grades 1/1A and 2/2A operators are required to complete two hours of training in the
topic of cybersecurity every five years, while Grades 313A and 414A operatorsare
required to complete four hours of training in cybersecurity.topics every five'years.
These hours are included within the overall number of required hours — they are not in
addition to the total required hours.

DEC -approved trainings are listed on DEC's. Wastewater Cybersecurity Resources

Cybersecurity Resoi/r`ces"section and click on the plus sign next to "Training." If a,
training provider'does not'provide a DEC RTC number,'operators should reach aut to
waters oer d'e':n' ov before taking'`a training to ensure it will be counted toward the
requirement.'DEC does<nQ.t�guarantee that a course that is taken without prior DEC
approval will be accepted.
Annual Certifications: The principal executive officer or ranking elected official (or
duly -authorized executive -level official) of any municipality that is the legally responsible
party (LRP) for a POTW must certify an'nually,�' by March 28th, that the POTW is complying
with the new requirements. The first required annual certifications will be due on or
before March 28, 2027 through DEC's nForm platform.
Each of the following new requirements applies only to Publicly Owned Treatment Works
(POTWs), Each of the following requirements is effective. March 11, 2027.
• Emergency Response plan (ERP)and-Cybersecurity Incident Response Plan
(IRP): POTWs are required to use either existing plans. (if certain requirements are
met) or.establish,. maintain, andimplement new plans using United States
Environmental Protection Agency (EPA) templates incorporated by reference into the
regulations. The_cybersecurity IRP must be.incorporated into the -overall ERP. See 6
NYCRR 750-2.9(d) and 2.9(e)(3).
• Access Control and Authentication: POTWs must establish, maintain, and
implement written rules and/or procedures that address password security, complexity
and. management; disallow use of default credentials; and require multi -factor
authentication (MFA) for any allowable remote access to Operational Technology
(OT). See 6 NYCRR 750-2.9(e)(1.)(i).
• Vulnerability Management: POTWs. must establish, maintain,. and implement a
written cybersecurity vulnerability management process that incorporates specific
steps laid out in the regulation. See 6 NYCRR 750-2.9(e)(1)(ii).
• Secure Network Structure: POTWs must establish, maintain, and implement a
written description ofnetwork structure that protects, operational technology (OT) by
separating it completely from information technology (IT), and,;oxter.nal networks such
as the internet,.or by.securin.g necessary l.connections using appropriate cy,bersecurity
..:controls See 6 NYCRR 750-2.9(e),(1)0ii).
• Network Monitoring and Logging-; POTWs with des ign flows 1.Q:million- gallons per
day (MGD) or more, must implement network monitoring and logging„ unless:/) there
is no connection between IT/external networks and OT, or 2) the only connection

a variety of free cybersecurity services and resources offered by state and federal
agencies. Also notably, at the request of Stakeholders during regulation development,
DEC prepared'the following resources specifically to assist in understanding and

Dear Colleagues in the Wastewater Community:
On March 11, 2026, the New York State Department of Environmental Conservation
(DEC) published a Notice of Adoption in the New York State Register and in the
Environmental Notice Bulletin to amend Parts 616, 650, and 750 of Title 6 of the Official
Compilation of Codes, Rules, and Regulations of the State of New York (6
NYCRR). These new regulations add wastewater cybersecurity and related
regulations for New York wastewater treatment facilities. Please share the following
information with anyone in your municipality who'may be impacted and encourage them
to contact DEC with questions at waters ber dec.n x ov.
._cybersecurity Incident Reporting
On March 26, 2026 the first requirement becomes effective. Under 6 NYCRR 750-2.7(h)
all State Pollutant Discharge Elimination System (SPDES) permittees; both publicly and
privately owned, must report all cybersecurity incidents to DEC within 24 -hours of
becoming aware of the incident. Please refer to the attached flyer entitled "Now to
Report a Wastewater Cybersecurity Incident to DEC' for more details.
Required- Operators
6 NYCRR 650.8 and 650.12 require that wastewater treatment plant operators, certified
in accordance with Part 650, complete a minimum number of training hours on the topic
of cybersecurity, to renew their certification every five years,
Grades 111A and 212A operators are required, to complete two hours of training in the
topic of cybersecurity every five years, while Grades 313A and 414A operators are
required to complete four hours of training in cybersecurity topics every five years.
These hours are included within the overall .number of required hours= they are not in
addition to the total required hours.

Annual Certifications: The principal executive officer or ranking elected official (or
duly -authorized executive -level official) of any municipality that is the legally responsible
party (LRP) for a POTW must certify annually, by March 28th, that the POTW is complying
with the new requirements. The first required annual certifications will be die on or
before March 28, 2027 through DEC's nForm platform.
Each of the following new requirements applies only to Publicly Owned Treatment Works
(POTWs). Each of the following requirements is effective March 11,'2027.
• . Emergency Response. Plan (ERP) and Cybersecurity;Incident Response Plan
(IRP): POTWs are required, to use either existing plans (if certain requirements are
met) or establish, maintain, and imple.ment.new plans. using United States
Environmental Protection Agency (EPA) templates incorporated by reference .into the
regulations. The. cybersecurity IRP must be incorporated into the overall ERP.See 6
NYCRR 750-2.9(d) and 2.9(e)(3).
• Access Control and Authentication:.POTWs must establish, maintain, and
implement written rules and/or procedures that address password security, complexity
and management; disallow use of default credentials; and require multi -factor.
authentication (MFA) for any allowable remote access to Operational Technology
(OT). See 6 NYCRR 750 2.9(e)(1)(i)•
• Vulnerability Management; POTWs must establish, maintain, and implement a
written cybersecurity vulnerability management process that incorporates specific
steps laid out in the regulation. See 6 NYCRR 750-2,9(e)(1)(ii).
• Secure Network Structure: POTWs.must establish, maintain, and implement a
written description of,;network structure that protects operational technology (OT) by
separatingit completely from information technology (IT) and external networks such
as the Internet or by securing necessary connections using appropriate cybersecurity

WHEREAS, the Town Board has considered the adoption of Local Law Amending Chapter
240-36.3 Of The Town Code Entitled "Solar Energy Systems"; and
WHEREAS, a Public Hearing on the proposed Local Law was duly advertised in the
Southern Dutchess News and the Poughkeepsie Journal as required by law; and
WHEREAS, a Public Hearing was held on March 23, 2026 and all parties in attendance
were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or
any part thereof; and
WHEREAS, the Town Board has determined that the Proposed Action is an action for
which there are no other Involved Agencies and that the Town Board is therefore, by default, the
Lead Agency for this action; and
WHEREAS, said Local Law has been on the desks of the members of the Town Board of
the Town of Wappinger for at least ten (7) days prior to the adoption of this resolution.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The Town Board hereby adopts and incorporates the recitations and statements set
forth above as if fully set forth and resolved herein.
2. The Town Board, after due deliberation, finds that it is in the best interest of the
Town to adopt said Local Law, and the Town Board hereby adopts Local Law No. 7
of 2026, a copy of which is attached hereto and made a part of this Resolution; and
3. The Town Clerk is directed to enter said Local Law in the minutes of this meeting
into the Local Law book for the Town of Wappinger and to give due notice of the
adoption of said Local Law to the Secretary of State of New York.

LOCAL LAW NO. OF THE YEAR 2026
A LOCAL LAW AMENDING CHAPTER 240-36.3 OF THE TOWN CODE OF THE
TOWN OF WAPPINGER ENTITLED "SOLAR ENERGY SYSTEMS"
BE IT ENACTED by the Town Board of the Town of Wappinger, County of Dutchess,
as follows:
Section 1: Section 240-36.3 of the Town of Wappinger Town Code is
hereby amended "Solar Energy Systems" as a Permitted Accessory Use
subject to the conditions specified in Section 240-36.3.
§ 240-36.3 Solar Energy Systems.
A. Statutory authority and jurisdiction.
(1) This section is hereby enacted pursuant to the provisions of Section 20 of the
Municipal Home Rule Law and Sections 261 and 263 of Town Law of the State of
New York, which authorize the Town of Wappinger to adopt zoning provisions that
advance and protect the health, safety, and welfare of the community, and
make provision for, so far as conditions may permit, the accommodation of Solar
Energy Systems and equipment, and access to sunlight necessary therefor.
(2) The authority to issue site plans pursuant to the provisions of this section is hereby
delegated to the Town of Wappinger Planning Board.
(3) References herein to zoning districts in the Town of Wappinger are references to
such districts as described in this Chapter 240 of the Town of Wappinger Code.
B. Statement of purpose and intent.
(1) This section is adopted to advance and protect the public health, safety, and welfare
of the Town of Wappinger, including:
C. Definitions.
ACCESSORY USE
A use which is customarily incidental and subordinate to the Principal Use of a lot
or water area, and which is located on the same lot or water area therewith.
ALTERNATING CURRENT
An electric current that reverses direction at regular intervals, having a magnitude
that varies continuously in a sinusoidal manner.
BUILDING -INTEGRATED SOLAR ENERGY PRODUCT
A building product that incorporates solar energy modules and functions as a
component of the building envelope, which produces electricity for on-site
consumption. These include, without limitation, vertical facades, semi -transparent
skylight systems, roofing materials, and window shades.
BUILDING -INTEGRATED SOLAR ENERGY SYSTEM
A Solar Energy System that uses Building -Integrated Solar Energy Products.
DIRECT CURRENT
An electric current of constant direction, having a magnitude that does not vary or
varies only slightly.
FACILITY AREA
This shall include: (1) all of the area within any fence surrounding a Solar Energy
System; and (2) the area covered by and between all Solar Energy System
components, including, but not limited to, access roads, transmission lines, and
support buildings.
GROUND -MOUNTED SOLAR ENERGY SYSTEM
A Solar Energy System that is: (i) anchored to the ground or supported on a
foundation; (ii) attached to a frame or other mounting system; or (iii) detached from
any other structure. A Ground -Mounted Solar Energy System must be used
primarily for producing electricity for on-site consumption, and must be approved
by the Town of Wappinger Planning Board. A Ground -Mounted Solar Energy
System requires Site Plan Approval by the Town of Wappinger Planning Board, and
must comply with the regulations set forth in Sub Section 215-38.1(H) of this
Chapter.
KILOWATT (kW)
A unit of electrical power equal to 1,000 watts, which constitutes the basic unit of
electrical demand. A watt is a metric measurement of power (not energy) and is the
rate (not the duration) at which electricity is used. One thousand kW is equal to
one Megawatt (MW).
KILOWATT-HOUR (kWh)
A unit of energy equivalent to one Kilowatt (kW) of power expended for one hour
of time.

LARGE-SCALE SOLAR ENERGY SYSTEM
A Solar Energy System that produces more than one hundred and ten percent E
(110%) of the solar energy needed to serve the principal and accessory structures

on site. Large -Scale Solar Energy Systems are prohibited within the Town of
Wappinger.
LOT COVERAGE
That percentage of the lot area covered by the combined area of all buildings or
structures on the lot.
MEGAWATT (MW)
A unit of electrical energy equal to 1,000 Kilowatts. A watt is a metric
measurement of power (not energy) and is the rate (not the duration) at which
electricity is used.
MEGAWATT -HOUR (MWh)
A unit of energy equivalent to one Megawatt (MW) of power expended for one
hour of time.
NAMEPLATE CAPACITY
A Solar Energy System's maximum electric power output under optimal operating
conditions. Nameplate Capacity may be expressed in terms of Alternating Current
or Direct Current.
PLANNING DIVISION
For the purposes of this Sub -Section, the Planning Division of the Town of
Wappinger Code Enforcement Office shall be made up of the Secretary of the Town
of Wappinger Planning Board, the Town of Wappinger Planning Board, and the
Town of Wappinger Zoning Board of Appeals. Applications for Solar Energy
Systems which require the Town of Wappinger Planning Division's approval shall
be submitted to the Planning Division and shall be subject to Site Plan Approval by
the Town of Wappinger Planning Board.
PRINCIPAL SERVICE
All Solar Energy Systems in the Town of Wappinger shall principally serve the
buildings or structures on the property in question, whereby the owner can only
produce one hundred and ten percent (110%) of a property's solar energy needs,
including emergency needs. The buildings or structures must be located on the
same lot as the Solar Energy System.
PRINCIPAL USE J
The main use conducted on a lot, dominant in area, extent, or purpose, to other uses
which may also be located on the lot. �°

ROOF -MOUNTED SOLAR ENERGY SYSTEM E

A solar energy panel system installed on or above the roof covering of a legally
permitted structure for the purpose of producing electricity for on-site consumption.
Roof -Mounted Solar Energy Systems are comprised of solar energy panels that are
either: (i) fixed and flush -mounted parallel to the roof, (ii) placed on rack -supported
systems that may be articulated and tilted; (iii) solar energy roof coverings; or (iv)
any combination of the three. A Roof -Mounted Solar Energy System cannot
extend past the roofline.
SITE PLAN APPROVAL
All Ground -Mounted Solar Energy Systems, require Site Plan Approval by the
Town of Wappinger Planning Board. All Solar Energy Systems which require Site
Plan Approval must comply with the regulations set forth in the Town of Wappinger
Town Code.
SMALL-SCALE SOLAR ENERGY SYSTEM
A Solar Energy System that does not exceed more than one hundred and ten percent
(110%) of the solar energy needed to serve the principal and accessory structures
on the lot upon which the system is located. Nothing contained in this provision
shall be construed to prohibit the sale of the excess ten percent (10%) of power not
required for the on-site needs through a net billing or net metering arrangement
made in accordance with New York Public Service Law Section 66-j, or a similar
state or federal statute.
SOLAR ACCESS
Space open to the sun and substantially clear of overhangs or shade, including the
orientation of streets and lots to the sun so as to permit the use of a solar energy
system on individual properties.
SOLAR ENERGY EQUIPMENT
Electrical energy storage devices, materials, hardware, inverters, or other electrical
equipment and conduits of solar energy devices associated with the production of
electrical energy.
SOLAR ENERGY SYSTEM N
CD
An electrical generating system composed of a combination of Solar Panels and
Solar Energy Equipment that produces electricity for primarily on-site
consumption.

SOLAR PANEL
A solar energy device capable of collecting and converting solar energy into �°
electrical energy. It is normally either: (i) attached to a building by mechanical
means and is readily removable and replaceable; or (ii) it is ground -mounted and
utilizes structural components.

D. Safety requirements.
(1) All Solar Energy Systems shall comply with the New York State Uniform Fire
Prevention and Building Code and the New York State Energy Conservation
Construction Code established pursuant to New York Executive Law Section
3 81(2) (hereinafter referred to as the "NYS Uniform Code"), as well as any other
applicable laws or regulations, to ensure compliance with all safety standards,
including fire access.
(2) In the event that the New York Uniform Code contains more restrictive regulations
covering Solar Energy Systems than those noted in this Sub -section and the
regulations conflict, then the NYS Uniform Code regulations shall prevail.
(3) Solar Energy Systems shall be maintained in good working order and in accordance
with industry standards. Site access shall be maintained, including snow removal
at a level acceptable to the Town of Wappinger Fire Prevention Bureau.
E. Applicability.
(1) The requirements of this Section apply to all Solar Energy Systems and
equipment installed or modified after the effective date of this Section, excluding
general maintenance and repair.
(2) Solar Energy Systems constructed or installed prior to the effective date of this
Section shall not be required to meet the requirements of this Section. However, if
fifty-one percent (51%) of the Nameplate Capacity of a Solar Energy System that
was previously constructed or installed prior to the effective date of this Section is
repaired, then the full Solar Energy System must comply with the requirements of
the current Code.
(3) Farms within the Agricultural District, as defined in Article 25 -AA of the New York
State Agriculture and Markets Law, must only use Solar Energy Systems for farm
uses. Additionally, farms should not use prime farmland for such Solar Energy
Systems. The definition of prime farmland shall be the same definition as that
promulgated by the United States Department of Agriculture.
(4) Roof -Mounted Small -Scale Solar Energy Systems installed on single -and multi-
family residential properties are subject to compliance with this Chapter under the
authority of the Building Inspector/Code Enforcement Officer, and generally do not �°
require review and approval from the Town of Wappinger Planning Board.
(5) The following shall be automatically subject to review by the Planning Division:

(a) Roof -Mounted, Small -Scale Solar Energy Systems installed on non-
residential properties;
(b) Roof -Mounted Solar Energy Systems that produce more than 25 kW DC,
as rated by their Nameplate Capacity; and
(c) All Small -Scale Ground -Mounted Solar Energy Systems, regardless of the
size of the Solar Energy Systems or the zoning district they are located in.
F. Installation requirements for all Solar Energy Systems.
(1) A building permit shall be required for the installation of all Solar Energy Systems
(2) All Solar Energy System installations must be performed in accordance with
applicable electrical and building codes, the manufacturer's installation
requirements, and industry standards.
(3) Prior to the operation of the Solar Energy System, the electrical connections must
be inspected by the Building Inspector/Code Enforcement Officer, and by an
appropriate electrical inspector or agency, as approved by the Town of Wappinger,
funding for which shall be paid for by the applicant. Letters of inspection must be
provided to the Building Inspector/Code Enforcement Officer prior to the issuance
of a certificate of occupancy or certificate of compliance.
(4) Any connection to the public utility grid must be inspected by the appropriate public
utility, and documentation certifying this inspection must be provided to the
Building Inspector/Code Enforcement Officer prior to the issuance of a certificate
of occupancy or certificate of compliance.
(5) Approvals by the Town of Wappinger Planning Board shall include a review
pursuant to the State Environmental Quality Review Act [ECL Article 8 and its
implementing regulations at 6 NYCRR Part 617 ("SEQRA")].
(6) For Solar Energy Systems subject to Site Plan Approval, the Town of Wappinger N

shall impose, and may update as appropriate, a schedule of fees to recover
expenses associated with engineering, environmental, or legal services LU
determined to be reasonably necessary in the processing of an application
under this law.
(7) Prior to the issuance of the building permit and final approval by the Town of (°
Wappinger Planning Board, construction and/or site plan documents must be signed
and stamped by a New York State Licensed Professional Engineer or a New York E
State Registered Architect.
(8) Infrastructure required for the installation of any Solar Energy System, including
all Solar Panels, integrated monitoring systems, performance measuring
equipment, batteries, and any screening, must be contained within the boundary
lines of the property owner and outside of any utility/public right-of-way.
(9) Infrastructure required by the utility for utility interconnection located in a
utility/public right-of-way, and upgrades to an existing overhead utility service
drop, are permitted.
(10) All warning signs, equipment markings, and installations of Solar Energy Systems
shall be in accordance with the New York State Uniform Code, the National Electric
Code, the National Fire Protection Association Codes and Standards, and any other
applicable laws and regulations.
(11) The use and siting of Solar Energy Systems shall be compatible with the Town's
Greenway Connections Ordinance and Comprehensive Plans.
G. Roof -Mounted Solar Energy Systems.
(1) Rooftop -mounted solar energy systems are permitted accessory uses in all zoning
districts.
(2) Rooftop -mounted solar energy systems installed on one -family dwellings and
accessory buildings for one -family dwellings are permitted accessory uses in all
zoning districts.
(3) Rooftop -mounted solar energy systems installed on new or existing buildings, other
than one -family dwellings, are subject to site plan or special permit approval in the
same manner as the building in which they are installed.
(4) Notwithstanding the provisions of § 240-22, solar collectors may exceed the
maximum height limitations for the zoning district, provided that such structures
are erected only to such height as is reasonably necessary to accomplish the purpose
for which they are intended to serve; however, in no event shall the solar collector
exceed the height limitation in the district by more than six feet.
(5) Nonconforming uses. Rooftop -mounted solar energy systems are permitted to be
installed on a building housing a nonconforming use, provided that they conform
to the other requirements of this section. �°
(6) Dimensionally nonconforming buildings. Rooftop -mounted solar energy systems
may be installed on existing buildings that do not conform to the setback requirements of
the district, provided that they do not increase the nonconformity. Rooftop -mounted solar

energy systems may be installed on existing buildings that do not conform to the height
requirements of the district, provided that they comply with Subsection E(4) above.
(7) Roof -mounted photovoltaic systems installed on one- or two-family dwellings may
be reviewed under the Unified Solar Permit.
H. Small -Scale Ground -Mounted Solar Energy Systems.
(1) Small -Scale Ground -Mounted Solar Energy Systems are permitted through the
issuance of Site Plan Approval within all zoning districts, as indicated in the Use
Table included at the end of this Chapter, and subject to: (i) any overlay district
regulations set forth in the Town of Wappinger Code and (ii) the requirements set
forth in this Section.
(2) Installations of Small -Scale Ground -Mounted Solar Energy Systems will be treated
as accessory structures to Legally Permitted Structures, subject to the requirements
set forth in this Section.
(3) All Solar Panels shall be dark -colored (blue or black material) and designed with
an anti -reflective coating.
(4) The applicant and the Town of Wappinger Planning Board shall consider possible
glare from the Solar Panels when designing the Solar Energy System.
(5) All Small -Scale Ground -Mounted Solar Energy Systems in all zoning districts shall
be installed in the side yard or rear yard.
(6) Small -Scale Ground -Mounted Solar Energy Systems are subject to setback
requirements of the underlying zoning district with a minimum setback of at least
one hundred (100) feet from any property line. The Town of Wappinger Planning
Board has the authority to increase the setback requirements where there is an
adverse impact.
(7) Small -Scale Ground -Mounted Solar Energy Systems are restricted to a height of
ten (10) feet from the ground under the Solar Panel to the highest point of the Solar
Panel or racking structure, whichever is greater.
(8) Small -Scale Ground -Mounted Solar Energy Systems visible during leaf -off
conditions, when viewed from the edge of an applicant's property line, shall be
screened from adjacent properties and public rights-of-way by fencing, a landscape �°
buffer, or a combination thereof, to minimize visual impact from the system to
either public roads or neighboring properties. The screening shall be maintained at
all times and shall be replaced as soon as practicable if damaged or destroyed for

any reason. The Town of Wappinger Planning Board has the authority to take the
physical characteristics of the site into consideration as it relates to view -shed and
screening requirements.
(9) Each applicant shall submit a copy of their application to the public electrical utility.
Foreseeable infrastructure upgrades shall be documented and submitted, and all
materials shall be submitted to the Town of Wappinger Planning Board concurrent
with application materials for Site Plan Approval. All materials shall be subject to
approval by the Town of Wappinger Planning Board. No building permit will be
issued for a Small -Scale Ground -Mounted Solar Energy System until such time as
the electrical utility has verified its approval. Off -grid systems and systems
designed to produce energy solely for the site it is installed on are exempt from this
requirement.
(10) The total surface area of the Small -Scale Ground -Mounted Solar Energy System
shall be included in Lot Coverage calculations and impervious coverage
calculations. Lot Coverage for Ground -Mounted Solar Energy Systems shall
comply with the maximum impervious surface coverage requirements of the
underlying zoning district, as set forth in the Dimensional Table included at the
end of this Chapter.
(11) It is the strong preference of the Town of Wappinger that the installation of Small -
Scale Ground -Mounted Solar Energy Systems do not require the removal of mature
trees or forests. Therefore, where practicable, Ground -Mounted Solar Energy
Systems shall be located on portions of properties that are currently free of trees.
(12) All Small -Scale Ground -Mounted Solar Energy Systems in residential districts
shall be installed on properties that are a minimum of five (5) acres in size or more,
and they shall be installed in the side or rear yards.
(13) Applications for Small -Scale Ground -Mounted Solar Energy Systems.
(a) Applications for the installation of Small -Scale Ground -Mounted Solar N
Energy Systems shall be reviewed by the Building Inspector/Code N
Enforcement Officer and the Planning Division, who shall refer the
application, with comments, to the Town of Wappinger Planning Board for
its review and action, which can include approval, approval with conditions,
or denial of Solar Energy System applications. If the application includes
environmentally sensitive lands, the Planning Board may refer the
application to the Town's environmental consultant. �°
(b) The application to the Town of Wappinger Planning Board for Site Plan
Approval shall include all items set forth in the Town of E
X
Wappinger Zoning Code and the New York State unified residential solar
energy permit application. Additionally, all applications shall include:
(i) The name, address, and contact information of the proposed or
potential system installer. Such information regarding the final
system installer shall be submitted prior to the issuance of a building
permit.
(ii) The name, address, and contact information of the owner and/or
operator of the Solar Energy System.
(iii) The name, address, contact information, and signature of the project
applicant, as well as all of the property owners, demonstrating their
consent to the application and the use of the property for the Solar
Energy System.
(iv) The Nameplate Capacity of the Solar Energy System (as expressed
in kW or MW).
(v) The zoning district designation for the parcel(s) of land comprising
the Facility Area.
(vi) Property lines and physical features, including roads, for the Facility
Area.
(vii) Adjacent land uses on contiguous parcels within a three hundred
(300) foot radius of the Facility Area.
(viii) Proposed changes to the landscape of the site, including site grading,
vegetation clearing, planting, the removal of any large trees, access
roads, exterior lighting, signage, fencing, landscaping, and
screening vegetation or structures.
(ix) A one- or three -line electrical diagram detailing the entire Solar N
CD
Energy System layout, including the number of Solar Panels in each
ground -mount array, solar collector installation, associated LU
components, inverters, electrical interconnection methods, and
utility meter, with all National Electrical Code compliant
disconnects and over current devices. The diagram should describe
the location and layout of all battery energy storage system �°
components, if applicable, and should include applicable setback
and other bulk and area standards. E

(x) A preliminary equipment specification sheet that documents all
proposed Solar Panels, system components, mounting systems,
racking system details, and inverters that are to be installed. A final
equipment specification sheet shall be submitted prior to the
issuance of a building permit.
(xi) Any information which the Town of Wappinger Planning Board
deems reasonably relevant in order to properly review the
application for the Small -Scale Ground -Mounted Solar Energy
System.
(14) Abandonment of Small -Scale Ground -Mounted Solar Energy Systems.
(a) All applications for Small -Scale Ground -Mounted Solar Energy Systems
shall be accompanied by a decommissioning plan to be implemented upon
abandonment, cessation of activity, or in conjunction with the removal of
the Ground -Mounted Solar Energy System, prior to the issuance of a
building permit. The decommissioning plan shall be accompanied by a
budget showing the cost of implementing the plan, certified by the project
engineer and approved by the Town Board, and the applicant shall provide
a performance bond or New York State bank letter of credit, for the benefit
of the Town of Wappinger, in the amount shown on the budget, plus fifty
percent (50%), available to the Town of Wappinger for the life of the Solar
Energy System or for so long as necessary to complete decommissioning,
whichever is longer. This security will not be released until the Small -Scale
Ground -Mounted Solar Energy Systems is fully decommissioned as set
forth herein. The form and amount of the security must be reviewed and
approved by the Town Board in conjunction with the Town Engineer and
the Town Attorney. The security must remain in effect until the Small -Scale
Ground Mounted Solar Energy System is removed. Review of the security
by the Town Engineer and/or Town Attorney shall be paid from an escrow
established by the applicant.
(b) The decommissioning plan shall include a time frame for the completion of
site restoration work. Additionally, the decommission plan must ensure the LU
site will be restored to a useful, non -hazardous condition without delay,
including, but not limited to, the following:
(i) Restoration of the surface grade and soil after removal of equipment, �°
as well as testing of the soils, if appropriate;

(ii) Removal of above -ground and below -ground equipment, structures,
and foundations; and
(iii) Revegetation of restored soil areas with native seed mixes,
excluding any invasive species.
(c) In the event that a Solar Energy System is not completed and functioning
within twelve (12) months of the issuance of the final Site Plan Approval,
the operator and/or owner of the Solar Energy System may request an
additional extension of six (6) months from the Town of Wappinger
Planning Board to complete the Solar Energy System. The Town of
Wappinger Planning Board can choose to grant the extension
unconditionally, grant the extension with conditions, or deny the extension.
(d) In the event that the Solar Energy System is not completed and functioning
within twelve (12) months of the issuance of the final Site Plan Approval,
unless an extension has been previously granted, the Town of Wappinger
may notify the operator and/or the owner to complete the construction and
installation of the Solar Energy System within one hundred and eighty (180)
days. If the owner and/or operator fails to perform, the Town of Wappinger
may notify the owner and/or operator to implement the decommissioning
plan. The decommissioning plan must be completed within one hundred
and eighty (180) days of notification by the Town of Wappinger.
(e) Upon cessation of activity of a constructed Solar Energy System for a period
of one (1) year, the Town of Wappinger may notify the owner and/or
operator of the Solar Energy System to implement the decommissioning plan.
Within one hundred and eighty (180) days of notice being served, the owner
and/or operator can either restore the operation equal to eighty percent
(80%) of the approved capacity or implement the decommissioning plan.
(f) If the owner and/or operator fails to fully implement the decommissioning ¢
plan within the one -hundred and eighty (180) day time period, the Town of CN
Wappinger may, at its discretion, provide for the restoration of the site in CN
accordance with the decommissioning plan and may recover all expenses N
incurred for such activities from the defaulted owner and/or operator, or LU
from the performance bond or letter of credit. All unreimbursed or
uncovered costs incurred by the Town of Wappinger shall be assessed J
against the property, shall become a lien and tax upon the property, and shall be
enforced and collected with interest by the same officer and in the same �°
manner as other taxes. c

(g) The owner and/or operator shall implement the decommissioning plan, and
remove and dispose of all Solar Energy System components, in compliance
with all applicable rules and regulations, including the regulations of the
New York State Department of Environmental Conservation.
Large -Scale Solar Energy Systems. Large -Scale Solar Energy Systems, as defined
previously in this Section, are not permitted uses under the provisions of the Town of
Wappinger Town Code.
Enforcement. Any violation of this Section shall be subject to the same civil and criminal
penalties provided for in the Town of Wappinger Code, a fee for the removal of the Stop
Work Order as set by Town Board Resolution, as the same may from time to time be
amended.
K. Ownership Changes. If the owner and/or operator of the Solar Energy System changes or
the owner of the property changes, Site Plan Approval shall remain in effect, provided that
the successor owner and/or operator assumes in writing all the obligations of the
decommissioning plan. A new owner and/or operator of the Solar Energy System shall
notify the Building Inspector/Code Enforcement Officer of such change in ownership or
operator within thirty (30) days of the ownership change.
Section 3: Severability.
If any part or provision of this local law or the application thereof to any person or
circumstance be adjudged invalid by any court of competent jurisdiction, such judgment shall be
confined in its operation to the part, provision, or application directly involved in the controversy
in which such judgment shall have been rendered and shall not affect or impair the validity of the
remainder of this local law, or the application thereof to other persons or circumstances, and the
Town Board of the Town of Wappinger hereby declares that it would have passed this local law
or the remainder thereof had such invalid application or invalid provision been apparent.
Section 4: Effective Date.
This local law shall take effect immediately upon filing in the Office of the New York State
Secretary of State in accordance with Section 27 of the Municipal Home Rule Law.

Resolution Authorizing Town Supervisor To Enter Into Letter
of Intent To Purchase 326 Acres Of Land,
WHEREAS, Wappingers RE LLC owns 326.34 acres of vacant land as shown on the
Town of Wappinger Tax Map as 135689-6158-04-951582 (the "Premises") and the Town of
Wappinger has negotiated for the purchase of the Premises by the Town for Two Million Seven
Hundred Thousand Dollars; and
WHEREAS, the Town Board wishes to authorize the purchase of the Premises for Town
purposes, pursuant to and in accordance with the provisions of Section 220 of the Town Law of
the State of New York, subject to the permissive referendum requirements of Town law Sections
90 and 91; and
WHEREAS, the Town Board wishes to authorize Town Supervisor Joseph D. Cavaccini
to sign a letter of intent for the purchase, which includes a downpayment in the amount of one
hundred and thirty five thousand dollars ($135,000), with contingencies for (i) compliance with
said permissive referendum requirements, (ii) clean title, and (iii) all standard vacant land
contract provisions to be incorporated into a contract upon the finalizing of any grant funding for
the Premises; and
WHEREAS, the Town Board further authorizes Town Supervisor Joseph D. Cavaccini
to apply for any and all grants that may pertain to the purchase and use of the Premises for Town
purposes.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of
Wappinger hereby authorizes the purchase of the premises and the entering into a letter of intent
for such purchase subject to the contingencies noted above, with a formal contract to be entered
upon completion of any necessary requirements in obtaining grant funding; and
BE IT FURTHER RESOLVED, that Town Supervisor Joseph D. Cavaccini is
authorized to solicit bids and otherwise contract for the performance of such tests, reports and
investigations as may be deemed necessary and prudent in order to determine the suitability of
the Premises, with our without renovations, for one or more Town purposes, subject to
compliance with the Town's Procurement policies and as otherwise required by law; and
BE IT FURTHER RESOLVED, that, pursuant to Town Law Sections 90 and 91, within ten
(10) days after the effective date of this Resolution, the Town Clerk, shall post and publish a

WHEREAS, the Town of Wappinger, desires to apply for $3.5 million in financial assistance through the
2025 DEC Open Space Conservation Grant Program, performance payments grant, involving interim
payment from DEC for the Town to use as upfront land and closing costs and a contract term of three
years; and
WHEREAS, the bid proposes funding for acquisition of land to for the purposes of protection from
development and for public benefit of all New Yorkers; and
WHEREAS, the property located at, and known as, the Cranberry Hills parcel is available for fee title
acquisition, and the landowner wishes to sell the land to the municipality for the purpose of establishing a
community forest; and
WHEREAS, the DEC will hold 10% of the total land cost in retainage at the closing until recorded deed
and final title insurance is received by DEC; and
NOW THEREFORE BE IT RESOLVED, that the Town Board of the Town of Wappinger approves and
endorses the bid for the 2025 DEC Open Space Conservation Grant Program and, recognizing this is a
performance-based payments grant that may require minimum amounts of funding upfront, an order of
operation for closing requirements and that the Town understands that if the total project funds exceed the
DEC funds, the Town will commit to utilizing general fund balance and/or existing capital reserve funds to
cover projectoverages; and
BE IT FURTHER RESOLVED, to the extent all or any actions hereby authorized have been executed

sale, lease, annexation or other transfer of 100 or more contiguous acres of land by a State or local
agency; and
WHEREAS, the Town Board is the only entity that can legislatively enact the purchase of this property
by the Town, the Town Board seeks to serve as the Lead Agency for this proposed action; and
WHEREAS, the Town Board prepared and reviewed Part 1 of a Full Environmental Assessment Form
("FEAF") as part of advancing the review of this proposed action; and
WHEREAS, the proposed action would not involve a federal agency; and
WHEREAS, conserving this Cranberry Hills property presents an opportunity to ensure future
development responds to and respects existing areas of important natural landscape features, as
discussed under the `Community Appearance & Character' section of the 2010 Comprehensive Plan,
which also identifies the same parcel as environmentally sensitive, noting it has been the subject of a
variety of development applications, prompting the Town Board to act under a belief there is a
significant and urgent risk of habitat and open space fragmentation if this lot is developed with new
residential housing; and
WHEREAS, in addition to this property's value as habitat and natural open space and its service in
underpinning biodiversity, the proposed action to conserve the property will support community-based
recreation opportunities, including but not limited to nature viewing and hiking; and
WHEREAS, as part of its value as habitat and natural open space, conserving natural cover, including
forests and the substantial wetlands onsite, this action will preserve a natural asset that serves as a storm
buffer, helping to mitigate the potential of flooding downstream from this property;
NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Wappinger in regular

Pursuant to the New York State Environmental Quality Review Act (SEQRA), the Town of Wappinger
Town Board has declared its intent to undertake the role of lead agency for the above listed, proposed
Type 1 Action. In accordance with SEQRA implementing regulations, the Town Board seeks to
coordinate SEQRA review among Involved Agencies.
The Town intends on purchasing the +/-326-acre Cranberry Hill parcel (PID#: 135689 6158-04-951382)
in the Town of Wappinger to conserve this property as open space. The current focus is on organizing
sufficient funding to complete this land purchase. Accordingly, there will be a request for grant assistance
from the Open Space Conservation Grant (OSCG) program of the New York State Department of
Environmental Conservation (NYSDEC). Undertaking this action is consistent with an August 11, 2025
Amendment to the 2010 Town Comprehensive Plan and 2010 Plan prescriptions, paraphrased: to ensure
that future development respects existing areas of important natural landscape features, including
Cranberry Hills (page 53), and to acquire this site for active and passive recreational uses (pp. 80).

Falls will limit sprawl and preserve an open space core 114 mile from Route 9 and the more densely developed commercial areas surrounding it, plus the
higher residential densities in and around the Village.
