Mr. Gates, a representative from Keene and Beane had objections to the local Law. He spoke of
the difficulties in getting approvals and suggested amendments for larger projects and provide
relief valve stating that the clock starts at the time of application.
Marcy Wagman spoke in support for the new town law and agreed that some work is being done
and the new law defines the starting of the 3 year clock NOT at the time of application or
issuance, but at the time that the last action or permits issued that were taken out.

Resolution Proclaiming February As Black History Month In The Town Of Wappinger
WHEREAS, the Town of Wappinger recognizes that Black History Month provides an
important opportunity to celebrate the achievements, contributions, and rich cultural
heritage of Black Americans who have played a vital role in shaping our nation, state, and
local communities; and
WHEREAS, the history of the United States is deeply intertwined with the history of African
Americans whose perseverance, leadership, innovation, and service have strengthened our
democracy, enriched our culture, and advanced the cause of equality and justice; and
WHEREAS, Black History Month traces its origins to Dr. Carter G. Woodson, who
established Negro History Week in 1926 to ensure that the accomplishments of Black
Americans would be recognized and studied as an integral part of American history; and
WHEREAS, the Town of Wappinger is committed to fostering a community thatvalues
diversity, promotes mutual respect, and ensures that all residents are treated with dignity
and fairness; and
WHEREAS, recognizing Black History Month encourages reflection on our shared history,
promotes understanding across cultures, and inspires future generations to continue the
work of building a more just and inclusive society;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger hereby
proclaims the month of February as Black History Month in the Town of Wappinger; and

Resolution Proclaiming February As American Heart Month In The Town Of Wappinger
WHEREAS, heart disease remains the leading cause of death for men and women in the
United States, affecting individuals, families, and communities across the nation, including
residents of the Town of Wappinger; and
WHEREAS, American Heart Month is observed each February to raise awareness about
heart disease, stroke prevention, and the importance of cardiovascular health; and
WHEREAS, many cases of heart disease and stroke can be prevented through healthy
lifestyle choices, including regular physical activity, balanced nutrition, maintaining a
healthy weight, avoiding tobacco use, managing stress, and receiving routine medical care;
and
WHEREAS, promoting heart health education empowers residents with the knowledge to
recognize the signs and symptoms of heart attack and stroke and to take timely action that
can save lives; and
WHEREAS, the Town of Wappinger encourages partnerships among healthcare providers,
community organizations, schools, and local leaders to promote wellness initiatives and
support healthier living for residents of all ages;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger hereby
proclaims the month of February as American Heart Month in the Town of Wappinger; and
BE IT FURTHER RESOLVED, that the Town Board encourages all residents to take steps to
improve their heart health, learn the warning signs of heart attack and stroke, and
participate in activities that promote cardiovascular wellness throughout the year.

Resolution Authorizing MJM Television And Video Productions To Record The 31st
Dutchess County St. Patrick's Parade
WHEREAS, the Town of Wappinger wishes to enhance the quality of life of its residents
through celebrations and special events, and
WHEREAS, the Dutchess County St. Patrick's Parade (parade) is a time honored tradition in
the Town of Wappinger and it is has been the precedent of the Town to cover the cost to
record and produce a video of the parade for those who cannot attend and for prosperity,
and
NOW THEREFORE BE IT RESOLVED, that the Town Board does hereby accepts the estimate
from MJM Television and Video Productions dated February 5, 2026 of $2,500.00 to record
and produce a video of the parade on March 7, 2026.

RESOLUTION: 2026-63
Resolution Authorizing Transfer Of Funds
WHEREAS, the Town of Wappinger has entered into a 2026 Service Agreement with the
Wappinger United Soccer Club, Inc. for the maintenance and support of Town -owned
soccer fields and park facilities; and
WHEREAS, pursuant to that agreement, the Wappinger United Soccer Club, Inc. provides
services that assist in the upkeep and preparation of Town athletic fields for community
use; and
WHEREAS, the purchase of field line paint is necessary to properly maintain and line the
soccer fields utilized for Town recreation programming and community athletic activities;
and

WHEREAS, the cost of such field line paint in the amount of $3,000 was not specifically
budgeted and requires a transfer of funds; and
WHEREAS, sufficient funds are available in A Fund Balance to cover this expense; and
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger hereby
authorizes a budget transfer in the amount of $3,000 from A Fund Balance to budget line
A.7145.400 - Joint Recreation Partnerships for the purpose of purchasing field line paint for
use by the Wappinger United Soccer Club, Inc. in maintaining Town -owned soccer fields
and parks in accordance with the 2026 Service Agreement; and
BE IT FURTHER RESOLVED, that Town Supervisor Joseph D. Cavaccini and Town
Comptroller Daniel O. Tucker are hereby authorized and directed to take all actions
necessary to effectuate this transfer.

Resolution Authorizing Budget Transfer For Equipment Purchase
WHEREAS, the Town of Wappinger Buildings & Grounds operations are responsible for the
maintenance of Town -owned properties, facilities, and sidewalks; and
WHEREAS, the Town currently relies on approximately 20 -year-old golf carts that are not
properly equipped, designed, or reliable for year-round maintenance activities, including
snow removal, grounds maintenance, and safe traversal of Town properties; and
WHEREAS, the purchase of a Kioti K9 Cab Side -by -Side with a 72 -inch snow plow
attachment will improve operational efficiency, enhance safety, and provide the capability
to plow sidewalks, access Town facilities in all weather conditions, and better maintain
Town -owned properties; and
WHEREAS, the total cost of said equipment is $38,124.00; and
WHEREAS, MTE Equipment Solutions, Inc. has provided the lowest estimate for the
equipment; and
WHEREAS, sufficient funds are available in the B -Fund Balance, and a budget transfer is
required to fund this purchase;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger hereby
authorizes the purchase of one Kioti K9 Cab Side -by -Side with 72" snow plow attachment
from MTE Equipment Solutions, Inc. in the amount of $38,124.00; and

BE IT FURTHER RESOLVED, that the Town Board authorizes a budget transfer in the amount

Comptroller Daniel O. Tucker are hereby authorized and directed to take all actions
necessary to effectuate this transfer and complete the purchase.

RESOLUTION: 2026-67
Proposed Improvements To Wildwood Wastewater Treatment Plant Resolution To
Declare Intent For Lead Agency And Classify Project As Unlisted Action
WHEREAS, the TOWN OF WAPPINGER has proposed implementing design changes to the Wildwood
Wastewater Treatment Plant (hereinafter referred to as WWTP); and
WHEREAS, the WWTP was built in the 1970's and serves 336 parcels consisting of single family,
multi -family and apartment units and has been maintained; and
WHEREAS, despite maintenance, a plan of action was required by NYSDEC requiring a change in the
outflow structure in accordance with the revised SPDES permit; and
WHEREAS, the Town Board contracted the services of Paggi engineering to assist the Town with the
examination of options to improve the WWTP facility to bring it in compliance with the SPDES permit in
a report to the Board dated October 28, 2025; and
WHEREAS, recommended improvements include the relocation of the existing effluent discharge
outfall, which was the most cost-effective choice and will extend the useful service of the existing WWTP
and will be pursued by the Town Board; and
WHEREAS, pursuant to 6 NYCRR 617.6 the Town Board seeks to be established as Lead Agency as
part of undertaking a coordinated review of this action with any Involved and Interested Agencies; and
WHEREAS, the Town Board considers the proposed Project to be an Unlisted Action, pursuant to the
New York State Environmental Quality Review Act (SEQRA) 6 NYCRR Part, and

WHEREAS, the Town Board has prepared the Short Environmental Assessment Form (SEAF) Part 1 in
accordance with SEQRA, and seeks to circulate a Notice of Intent to be Lead Agency (Notice), by mail
and email, to all Involved and Interested Agencies, who shall be given 30 days to deliver any comments
in response to this Notice that such other Involved or Interested entity may have regarding the Town
Board taking on the Lead Agency role;
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Wappinger duly
convened as follows:
1. The Town Board of the Town Wappinger classifies the project as an Unlisted Action pursuant to
standards in the New York State Environmental Quality Review Act; and
2. The Town Board of the Town of Wappinger declares its intent to serve as Lead Agency for
SEQRA Coordinated Review of this Action; and
3. The Town Board of the of the Town of Wappinger hereby directs the coordination of intent for
Lead Agency designation with all Involved Agencies for the Project through the service of a
notice of intent, indicating that the Town Board of the Town of Wappinger seeks to be designated
as Lead Agency for this Action; and
Due to the project's location within 500 feet of the Village of Wappinger Falls municipal boundary, the
Town Board directs the required referrals to the Village of Wappinger Falls and the County of Dutchess
Planning Department pursuant to GML-239 in review.

RESOLUTION: 2026-66
Resolution Introducing Local Law Amending Chapter 230 "Vehicles And Traffic" Of The
Town Code Of The Town Of Wappinger To Further Regulate Overnight Parking Of
Commercial Vehicles On Town Roads
WHEREAS, the Town Board of the Town of Wappinger is charged with protecting the health,
safety, and welfare of its residents and preserving the residential character of
neighborhoods within the Town; and
WHEREAS, the Town has previously adopted § 230-19.1 of the Town Code regulating the
overnight parking of commercial vehicles on Town roads in residential zoning districts; and
WHEREAS, the Town Board has identified the need to clarify and strengthen these
regulations to expressly address tow truckvehicles, which by their size, weight, equipment
configuration, and commercial function may create visual impacts, traffic visibility
concerns, roadway wear, and public safety issues when parked overnight on public roads
in residential areas; and
WHEREAS, the Town Board finds that prohibiting the overnight parking of tow truck vehicles
on Town roads in residential zoning districts is consistent with sound zoning principles and
advances the public interest;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby introduces Introductory
Local Law No. _ of 2026, entitled:
"A Local Law Amending Chapter 230 (`Vehicles and Traffic') of the Code of the Town of
Wappinger to Further Regulate Overnight Parking of Tow Truck Vehicles on Town Roads," a
copy of which is attached hereto and made a part hereof; and
BE IT FURTHER RESOLVED, that the Town Board shall hold a public hearing on said
proposed Local Law on the 23 day of February, 2026 at 7:00 p.m. at Town Hall, 20

Resolution Adopting Local Law Amending Chapter 217 of the Town Code of the Town of
Wappinger Relating to the Expiration and Final Approval of Subdivision Plats"
WHEREAS, the Town Board has considered the adoption of Resolution Amending Chapter
217 of the Town Code of the Town of Wappinger Relating to the Expiration and Final Approval of
Subdivision Plats",and
WHEREAS, a Public Hearing on the proposed Local Law was duly advertised in the
Southern Dutchess News and the Poughkeepsie Journal as required by law; and
WHEREAS, a Public Hearing was Noticed Properly and held on February 9, 2026 and all
parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said
proposed Local Law or any part thereof; and
WHEREAS, the Town Board has determined that the Proposed Action is an action for which
there are no other Involved Agencies and that the Town Board is therefore, by default, the Lead
Agency for this action; and
WHEREAS, as in accordance with Section 239 of the New York State General Municipal Law,
the Town Board referred the proposed Local Law to the Dutchess County Department of Planning
and Development (DCDPD) for its advisory opinion; and
WHEREAS, said Local Law has been on the desks of the members of the Town Board of
the Town of Wappinger for at least ten (7) days prior to the adoption of this resolution.

NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The Town Board hereby adopts and incorporates the recitations and statements set forth

2. The Town Board, after due deliberation, finds that it is in the best interest of the Town to
adopt said Local Law, and the Town Board hereby adopts Local Law of 2026, a copy of which is
attached hereto and made a part of this Resolution; and The Town Clerk is directed to enter said
Local Law in the minutes of this meeting into the Local Law book for the Town of Wappinger and to
give due notice of the adoption of said Local Law to the Secretary of State of New York.

Resolution Adopting Local Law Amending Chapter 221 Of The Town Code Of The Town
Of Wappinger Entitled "Taxation" By Adding Section 221 -IX Entitled "Exemption For
Permanently And Totally Disabled Military Veterans"
WHEREAS, the Town Board has considered the adoption of Local Law to amend Chapter
221 of the Town Code entitled "Taxation" by adopting a local law pursuant to the authority granted
under New York State Real Property Tax Law,and
WHEREAS, a Public Hearing on the proposed Local Law was duly advertised in the
Southern Dutchess News and the Poughkeepsie Journal as required by law; and
WHEREAS, a Public Hearing was Noticed Properly and held on February 9, 2026 and all
parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said
proposed Local Law or any part thereof; and
WHEREAS, the Town Board has determined that the Proposed Action is an action for which
there are no other Involved Agencies and that the Town Board is therefore, by default, the Lead
Agency for this action; and
WHEREAS, as in accordance with Section 239 of the New York State General Municipal Law,
the Town Board referred the proposed Local Law to the Dutchess County Department of Planning
and Development (DCDPD) for its advisory opinion; and

connection with its development of a motor vehicle sales establishment in the Town
of Wappinger. On behalf of CarMax, we are writing to provide comments on the
Town's proposed Local Law entitled "Local Law Amending Chapter 240-90 of the
Town Code Amending Final approval of Site Development Plan" (the "Proposed
Local Law"), which seeks to establish expiration deadlines for final site development
plan approvals.
While CarMax appreciates the Town's stated objective of promoting timely project
implementation, the Proposed Local Law as currently drafted would have significant
unintended consequences for projects that remain actively progressing but require
extended timelines due to outside agency coordination (e.g. New York State and
Dutchess County). Accordingly, CarMax respectfully objects to the Proposed Local
Law in its present form and offers the following comments and suggested
considerations for the Town's review.
I. The Proposed Local Law

and in the interests of ensuring that CarMax's comments are timely submitted for the
public record, the following comments are based on the only version of the Proposed =
Local Law that our office has been able to locatenamely, the draft included with the
January 26, 2026 Town Board agenda materials.2

The stated legislative intent of the Proposed Local Law is "to ensure that approved

[site development] plans are acted upon within a reasonable and predictable timeframe,

consistent with current planning procedures, infrastructure capacity, environmental
concerns, and community needs." To that end, the Proposed Local Law seeks to

amend Town Code § 240-90.B to (i) limit each extension of a site plan approval to one
(1) year, and (ii) impose a definitive cap such that final site plan approval cannot be

extended beyond three (3) years from the date of the original approval. By contrast, the
o
existing version of Town Code § 240-90.B affords the Planning Board discretion to
grant extensions of site plan approval where it deems warranted.
CarMax appreciates the Town's stated concern regarding site development plans that

"remain inactive for extended periods of time—sometimes years or decades—before
°
construction or implementation occurs." However, the Proposed Local Law as drafted

does not distinguish between approvals that have become inactive or abandoned, and

those that remain actively progressing, but require longer implementation timelines due

to their size, complexity, or dependence on third -party agency review. As presently
drafted, the Proposed Local Law treats fundamentally different circumstances in the
same manner, notwithstanding that projects such as CarMax's continue to advance in

good faith in satisfying conditions of final site plan approval.
As discussed further below, the proposed framework would have significant

consequences for projects (such as CarMax's) that remain actively progressing, but are

necessarily dependent upon approvals, permits, and coordination with multiple third -
party agencies outside of the applicant's control. In circumstances where substantial
financial investment has already been incurred in reliance upon validly issued approvals,

a rigid expiration framework risks undermining projects that continue to advance in
good faith.

II. A History of the Project and its Approvals

In March 2022, CarMax submitted applications to the Town of Wappinger Planning
i
Board seeking approvals for the construction of an auto sales establishment on a 7.5 -
acre property located at 1105-1115 Route 9 in the Town's HB Highway Business

Zoning
Zoning District (the "Property"). The applications were approved by the Planning
o
Board in August 2023.
o

After receiving the approvals, CarMax closed on its acquisition of the Property for
a�
approximately $4 Million. The Property is the site of the former Plant Depot and had
.�
been abandoned for several years prior to CarMax's acquisition due, in part, to the lack
of municipal water and sewer infrastructure in this area of Town. At the same time,
N
CarMax also set out to complete all conditions of approval set forth in the Planning
0
Board's resolution, including receipt of "outside agency" approvals such as NYS
O
Department of Transportation, NYS Department of Environmental Conservation, and
J
Dutchess County Department of Health ("DCDOH").

DCDOH approval was needed for the installation of a septic system and re-
J
o
establishment of a public water supply on the Property. The septic system was required
4
to go through a two-phase approval procedure that involved installation of a fill pad
c
E
followed by design approval by DCDOH. DCDOH issued approval for the installation
E
of the fill pad in May 2024. However, CarMax could not receive the necessary
v
demolition and grading permits from the Town since CarMax had not yet received final
c
sign off from DCDOH. That final sign off could not occur until after the installation
of the fill pad.
Since CarMax was caught in a "Catch 22," we returned to the Planning Board in August
0-
2024 to seek a modification of its resolution to allow the demolition and grading

permits to issue prior to CarMax securing final project approval from DCDOH. That
modification was granted in September 2024.

By February 2025, the Town was ready to issue the necessary permits to CarMax to 0
allow for the installation of the fill pad. The Town issued the required permits on March v
10, 2025, and CarMax had a pre -construction meeting with the Town on the same day.
Since that time, the fill pad has been installed and approved by DCDOH.
However, in April 2025, CarMax's professional engineering team was notified by
DCDOH of the adoption of the County's Aquifer Law, which added another layer of
regulatory complexity to the project. CarMax is actively processing its application with

DCDOH. Additional water testing is required by DCDOH but inclement and

unprecedented weather conditions have delayed that testing from taking place. Once
the testing is completed, CarMax's consultants will promptly resubmit materials to

DCDOH, together with responses to DCDOH's comments.

To date, CarMax has invested approximately $4 Million in acquiring the Property, as

well as almost $3 Million in engineering, consulting, and application -related expenses
o
in reliance upon the approvals issued and in furtherance of advancing the Project. If
�
the Proposed Local Law is adopted as currently drafted CarMax will not have an
opportunity to further extend its approvals in August 2026 despite its good faith and
v
diligent work since August 2023 in furtherance of its conditions of approval.

III. Practical Implications on CarMax and Suggested Considerations

It is not uncommon for complex commercial applications such as CarMax's to require
a longer implementation timeline than smaller or less complex projects. Importantly,
there is a meaningful distinction between approvals that remain dormant without

activity, and those that continue to progress in good faith. The rigid expiration
o
framework set forth in the Proposed Local Law may have the unintended consequence
of nullifying the approvals of complex projects that are otherwise actively progressing.

Accordingly, CarMax respectfully suggests that the Town consider the following
v
alternatives:
(1) Reconsider whether the proposed amendment is necessary in light of the
Planning Board's existing discretion under Town Code § 240-90.B;
(2) Include a grandfathering provision for projects that have already secured site
plan approval as of the effective date of the Proposed Local Law;
(3) Extend the proposed overall extension period from three (3) years to five (5)
years to better account for complex projects that require third -party agency
approvals, government funding, etc.; and/or
(4) Incorporate a discretionary "relief valve" allowing the Planning Board to grant
extensions beyond the proposed three (3) -year limit where extenuating
circumstances exist and the applicant demonstrates ongoing progress toward
completion.

The immediate application of the strict expiration framework in the Proposed Local
Law to projects such as CarMax's would create significant hardship, particularly where
millions of dollars have already been invested in reliance upon validly issued approvals. _
Moreover, the Proposed Local Law risks discouraging future investment by
introducing uncertainty into the development process for projects that, by their nature, a
require longer timelines. CarMax respectfully submits that adoption of one or more of rn
the above considerations would materially improve the Proposed Local Law while CD
maintaining the Town's broader planning objectives. N

WHEREAS, the Town of Wappinger has entered into a 2026 Service Agreement with the
Wappinger United Soccer Club, Inc. for the maintenance and support of Town -owned
soccer fields and park facilities; and
WHEREAS, pursuant to that agreement, the Wappinger United Soccer Club, Inc. provides
services that assist in the upkeep and preparation of Town athletic fields for community
use; and
WHEREAS, the purchase of field line paint is necessary to properly maintain and line the
soccer fields utilized for Town recreation programming and community athletic activities;

WHEREAS, the cost of such field line paint in the amount of $3,000 was not specifically

WHEREAS, the Town of Wappinger Buildings & Grounds operations are responsible for the
maintenance of Town -owned properties, facilities, and sidewalks; and
WHEREAS, the Town currently relies on approximately 20 -year-old golf carts that are not
properly equipped, designed, or reliable for year-round maintenance activities, including
snow removal, grounds maintenance, and safe traversal of Town properties; and
WHEREAS, the purchase of a Kioti K9 Cab Side -by -Side with a 72 -inch snow plow
attachment will improve operational efficiency, enhance safety, and provide the capability
to plow sidewalks, access Town facilities in all weather conditions, and better maintain
Town -owned properties; and
WHEREAS, the total cost of said equipment is $38,124.00; and
WHEREAS, MTE Equipment Solutions, Inc. has provided the lowest estimate for the
equipment; and
WHEREAS, sufficient funds are available in the B -Fund Balance, and a budget transfer is
required to fund this purchase;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger hereby
authorizes the purchase of one Kioti K9 Cab Side -by -Side with 72" snow plow attachment
from MTE Equipment Solutions, Inc. in the amount of $38,124.00; and
BE IT FURTHER RESOLVED, that the Town Board authorizes a budget transfer in the amount

Classify Project As Unlisted Action
WHEREAS, the TOWN OF WAPPINGER has proposed implementing design changes to the Wildwood
Wastewater Treatment Plant (hereinafter referred to as WWTP); and
WHEREAS, the WWTP was built in the 1970's and serves 336 parcels consisting of single family,
multi -family and apartment units and has been maintained; and
WHEREAS, despite maintenance, a plan of action was required by NYSDEC requiring a change in the
outflow structure in accordance with the revised SPDES permit; and
WHEREAS, the Town Board contracted the services of Paggi engineering to assist the Town with the
examination of options to improve the WWTP facility to bring it in compliance with the SPDES permit in
a report to the Board dated October 28, 2025; and
WHEREAS, recommended improvements include the relocation of the existing effluent discharge
outfall, which was the most cost-effective choice and will extend the useful service of the existing WWTP
and will be pursued by the Town Board; and
WHEREAS, pursuant to 6 NYCRR 617.6 the Town Board seeks to be established as Lead Agency as
part of undertaking a coordinated review of this action with any Involved and Interested Agencies; and
WHEREAS, the Town Board considers the proposed Project to be an Unlisted Action, pursuant to the
New York State Environmental Quality Review Act (SEQRA) 6 NYCRR Part, and
WHEREAS, the Town Board has prepared the Short Environmental Assessment Form (SEAF) Part 1 in
accordance with SEQRA, and seeks to circulate a Notice of Intent to be Lead Agency (Notice), by mail
and email, to all Involved and Interested Agencies, who shall be given 30 days to deliver any comments
in response to this Notice that such other Involved or Interested entity may have regarding the Town
Board taking on the Lead Agency role;
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Wappinger duly
convened as follows:
1. The Town Board of the Town Wappinger classifies the project as an Unlisted Action pursuant to
standards in the New York State Environmental Quality Review Act; and
The Town Board of the Town of Wappinger declares its intent to serve as Lead Agency for
SEQRA Coordinated Review of this Action; and
The Town Board of the of the Town of Wappinger hereby directs the coordination of intent for
Lead Agency designation with all Involved Agencies for the Project through the service of a

agency for the project intitled "Wildwood Wastewater Treatment Plant Improvements Project." We are sending you notice

The proposed project description is as follows:
The Wildwood Wastewater Treatment Plant (WWTP) is located at 99 New Hackensack Road on a 2.5 acre parcel that has
access to Wappinger Creek. The WWTP currently serves 336 parcels consisting of single family, multiple -family, and
apartment units in a development adjacent to New Hackensack Road. The permitted flow of this facility is 100,000 gpd
and is not expected to change in the near future. The facility has been continuously operating since the 1970's and has
undergone routine maintenance throughout its operating life. Due to a recent modification of the SPDES permit, the
WWTP requires a relocation of the existing effluent discharge, which requires a new gravity sewer main and new outfall.

WHEREAS, the Town Board of the Town of Wappinger is charged with protecting the health,
safety, and welfare of its residents and preserving the residential character of
neighborhoods within the Town; and
WHEREAS, the Town has previously adopted § 230-19.1 of the Town Code regulating the
overnight parking of commercial vehicles on Town roads in residential zoning districts; and
WHEREAS, the Town Board has identified the need to clarify and strengthen these
regulations to expressly address tow truckvehicles, which by their size, weight, equipment
configuration, and commercial function may create visual impacts, traffic visibility
concerns, roadway wear, and public safety issues when parked overnight on public roads
in residential areas; and
WHEREAS, the Town Board finds that prohibiting the overnight parking of tow truck vehicles
on Town roads in residential zoning districts is consistent with sound zoning principles and
advances the public interest;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby introduces Introductory
Local Law No. _ of 2026, entitled:
"A Local Law Amending Chapter 230 (`Vehicles and Traffic') of the Code of the Town of
Wappinger to Further Regulate Overnight Parking of Tow Truck Vehicles on Town Roads," a
copy of which is attached hereto and made a part hereof; and
BE IT FURTHER RESOLVED, that the Town Board shall hold a public hearing on said
proposed Local Law on the 23 day of February, 2026 at 7:00 p.m. at Town Hall, 20
Middlebush Road, Wappingers Falls, New York, and the Town Clerk is hereby authorized
and directed to publish and post notice of said public hearing as required by law; and
BE IT FURTHER RESOLVED, that the Town Clerk is directed to circulate copies of the
proposed Local Law and this resolution to all involved agencies as part of the review
process.

Of The Town Of Wappinger To Further Regulate Overnight Parking Of
Commercial Vehicles On Town Roads
SECTION 1. LEGISLATIVE INTENT AND PURPOSE
The Town Board finds that the overnight parking of heavy commercial vehicles on Town roads
within residential areas adversely affects neighborhood character, public safety, traffic visibility,
emergency access, roadway maintenance, and the quiet enjoyment of residential properties. Tow
truck vehicles, by their size, weight, equipment configuration, and commercial function, create
visual impacts and potential safety hazards when stored on public roadways overnight.
The purpose of this Local Law is to clarify and strengthen existing regulations by expressly
prohibiting the overnight parking of tow truck vehicles on Town roads in residential zoning
districts, while maintaining reasonable exemptions for emergency and necessary public service
activities.
SECTION 2. AUTHORITY
This Local Law is adopted pursuant to the Municipal Home Rule Law of the State of New York
and the Town Law of the State of New York, which authorize the Town to enact zoning and
traffic -related regulations for the protection of the health, safety, and welfare of its residents.
SECTION 3. AMENDMENT TO TOWN CODE
Section 230-19.1 of the Code of the Town of Wappinger, entitled "Overnight parking of
commercial vehicles prohibited," is hereby amended to read as follows:

WHEREAS, the Town Board has considered the adoption of Resolution Amending Chapter
217 of the Town Code of the Town of Wappinger Relating to the Expiration and Final Approval of
Subdivision Plats",and
WHEREAS, a Public Hearing on the proposed Local Law was duly advertised in the
Southern Dutchess News and the Poughkeepsie Journal as required by law; and
WHEREAS, a Public Hearing was Noticed Properly and held on February 9, 2026 and all
parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said
proposed Local Law or any part thereof; and
WHEREAS, the Town Board has determined that the Proposed Action is an action for which
there are no other Involved Agencies and that the Town Board is therefore, by default, the Lead
Agency for this action; and
WHEREAS, as in accordance with Section 239 of the New York State General Municipal Law,
the Town Board referred the proposed Local Law to the Dutchess County Department of Planning
and Development (DCDPD) for its advisory opinion; and
WHEREAS, said Local Law has been on the desks of the members of the Town Board of
the Town of Wappinger for at least ten (7) days prior to the adoption of this resolution.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The Town Board hereby adopts and incorporates the recitations and statements set forth
above as if fully set forth and resolved herein.
2. The Town Board, after due deliberation, finds that it is in the best interest of the Town to

LOCAL LAW NO. 3 OF THE YEAR 2026
A Local Law entitled "Local Law Amending Chapter 217 of the Town Code Amending
Final approval of subdivision plat."
BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section L• Title.
This Local Law shall be known and cited as "Local Law Amending Chapter 217 of the
Town Code Amending Final approval of subdivision plat."
Section IL• Legislative Intent.
The Town Board of the Town of Wappinger hereby finds and declares that the timely and
orderly review of subdivision applications is essential to protecting the public health, safety,
and general welfare of the community.
The intent of this Local Law amending Chapter 217 of the Town Code, relating to the final
approval of subdivision plats, is to ensure that approved subdivision plans are acted upon
within a reasonable and predictable timeframe, consistent with current planning standards,
infrastructure capacity, environmental conditions, and community needs.
At present, subdivision plats may receive final approval and remain inactive for extended
periods of time—sometimes years or decades—before construction or implementation
occurs. When such approvals are later reactivated, the underlying plans may no longer reflect
contemporary zoning standards, environmental regulations, infrastructure conditions, or the
Town's adopted planning goals, includingthose set forth in the Comprehensive Plan. This
practice undermines responsible land -use planning and can adversely impact roads,
schools, utilities, emergency services, and neighborhood character.
Accordingly, this Local Law establishes defined expiration deadlines for final subdivision
approvals, modeled after and consistentwith the timelines applicable to preliminary
subdivision approvals. The law provides that final approval of a subdivision plat shall expire
after a period of three (3) years unless substantial progress has been made or an extension
has been duly granted.
The Town Board further intends that applicants retain the ability to request extensions of final
approval within the prescribed timeframe, subject to review and approval by the Planning
Board. However, where final approval has expired after three (3) years, the applicant shall be
required to return to the Planning Board for renewed review and approval under the then -
current Town Code, standards, and policies.
Section III: Addition of Section E. Expiration and extensions of final subdivision plat
approval.
§ 217-14 Final approval of subdivision plat.
A. Signing of plat.
(1) The Planning Board will endorse approval on the plat after all conditions of the
resolution have been satisfied.
(2) Approval will be endorsed on the tracing cloth original of the plat. A copy of the
plat to be signed is to be submitted to the Planning Board Secretary before the
signing of the original.
B. Plat void if revised after signature. No changes, erasures, modifications or revisions shall
be made to any subdivision plat after approval has been given by the Board and endorsed,
in writing, on the plat. In the event that any subdivision plat, when recorded, contains such
changes, the plat shall be considered null and void.
C. Filing plat with County Clerk. In accordance with Town Law § 276, Subdivision 11, the
plat shall be filed with the Dutchess County Clerk within 62 days of the date of signing. The
approval of any plat not so filed shall expire 62 days from the date of signing.

WHEREAS, a Public Hearing on the proposed Local Law was duly advertised in the
Southern Dutchess News and the Poughkeepsie Journal as required by law; and
WHEREAS, a Public Hearing was Noticed Properly and held on February 9, 2026 and all
parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said
proposed Local Law or any part thereof; and
WHEREAS, the Town Board has determined that the Proposed Action is an action for which
there are no other Involved Agencies and that the Town Board is therefore, by default, the Lead
Agency for this action; and
WHEREAS, as in accordance with Section 239 of the New York State General Municipal Law,
the Town Board referred the proposed Local Law to the Dutchess County Department of Planning
and Development (DCDPD) for its advisory opinion; and
WHEREAS, said Local Law has been on the desks of the members of the Town Board of

INTRODUCTORY LOCAL LAW NO. 4 OF 2026 OF THE TOWN OF WAPPINGER
AMENDING CHAPTER 221 OF THE TOWN CODE OF THE TOWN OF WAPPINGER
ENTITLED "TAXATION" BY ADDING SECTION 221 -IX ENTITLED "EXEMPTION FOR
PERMANENTLY AND TOTALLY DISABLED MILITARY VETERANS"
Section 1. Legislative Intent.
It is hereby declared to be the intent of the Town Board of the Town of Wappinger to amend
Chapter 221 of the Town Code entitled "Taxation" by adopting a local law pursuant to the
authority granted under New York State Real Property Tax Law § 458-a(I1), in order to provide
a full exemption from Town and special district taxation for the primary residence of
permanently and totally disabled military veterans who meet the statutory eligibility
requirements.
Section 2. Text Amendment.
Chapter 221 of the Town Code of the Town of Wappinger entitled "Taxation" is hereby amended
by adding a new section to be known as Section 221 -IX, to read as follows:
§ 22 ll) .. Exemption for Permanently and Totally Disabled Military Veterans.
Pursuant to New York State 11.eal Property ll"u x Law § 458...a(i 1), the primary residence ol" any
permanently and totally disabled military veteran shall be fully exempt from Town and special
district charges, assessments, and special ad valorem levies, provided that such veteran meets all
o `the 1:61iowing requirements:
A. The veteran:
Was discharged or released from military service under honorable conditions, or
llllas a ciuualilying condition, as del:lned in Section i ol`the New York State
Veterans' Services Law, and has received a discharge other than bad conduct or
dishonorable, or
Is a discharged L(J13"ll" veteuln, as defined in Section i oJ`the New York State
Veterans' Services Law, and has received a discharge other than hard conduct or
dishonorable.
B. The veteran:
Is considered to be permanently and totally disabled as a result ol"military service,
and
Is routed one hundred percent (100%) disabled by the Invited States Department oJ"
Veterans AlTairs, or
ll llas been routed by the IJnited States Department oi" eterans A i 1.tirs as
individually unemployable.
C.The veteran:
Is eligible for pecuniary assistance from the Invited States government, or has
received such assistance, and
ll llas applied such assistance toward the acquisition or modification of` a suitable
housing unit with special features or movable 11wilities made necessary by the
nature of"the veteran's disability, as required by applicable law.
D. The real property f:or which the exemption is claimed must be used exclusively
as the veteran's primary residence and must otherwise meet all requirements set
forth in 11.eal PropertyTax. Law § 458 u.u(l l) and applicable rules and regulations.
Section 3. Authority.
This Local Law is enacted pursuant to the authority granted to the Town Board of the Town of
Wappinger by Municipal Home Rule Law §§ 10 and 20, Town Law § 130, and New York State
Real Property Tax Law § 458-a(11)
Section 4. Severability.
If any clause, sentence, paragraph, subdivision, section, or part of this Local Law shall be
adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect,
impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause,
sentence, paragraph, subdivision, section, or part thereof directly involved in the controversy in
which such judgment shall have been rendered.
Section 5. Effective Date.
This Local Law shall take effect immediately upon filing with the Secretary of State of the
State of New York.

BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section L• Title.
This Local Law shall be known and cited as "Local Law Amending Chapter 240-90 of
the Town Code Amending Final approval of Site Development Plan."
Section IL• Legislative Intent.
The Town Board of the Town of Wappinger hereby finds and declares that the timely and
orderly review of subdivision applications is essential to protecting the public health, safety,
and general welfare of the community.
The intent of this Local Law amending Chapter 240-90 of the Town Code, relating to the final
approval of Site Development Plan, is to ensure that approved plans are acted upon within a
reasonable and predictable timeframe, consistent with current planning standards,
infrastructure capacity, environmental conditions, and community needs.
At present, Site Development Plans may receive final approval and remain inactive for
extended periods of time—sometimes years or decades—before construction or
implementation occurs. When such approvals are later reactivated, the underlying plans may
no longer reflect contemporary zoning standards, environmental regulations, infrastructure
conditions, or the Town's adopted planning goals, including those set forth in the
Comprehensive Plan. This practice undermines responsible land -use planning and can
adversely impact roads, schools, utilities, emergency services, and neighborhood character.
Accordingly, this Local Law establishes defined expiration deadlines for final site plan
approvals, modeled after and consistent with the timelines applicable to preliminary
subdivision approvals. The law provides that final approval of a subdivision plat shall expire
after a period of three (3) years.
The Town Board further intends that applicants retain the ability to request extensions of final
approval within the prescribed timeframe, subject to review and approval by the Planning
Board. However, where final approval has expired after three (3) years, the applicant shall be
required to return to the Planning Board for renewed review and approval under the then- o

current Town Code, standards, and policies. N

§ 240-90 Expiration of approval.
A. Site plan approval shall expire in the event that:
(1) An application for a building permit or, where a building permit is not required, a
certificate of occupancy has not been made within one year of the date of approval;
(2) All construction in conformance with the approved site plan has not been
completed within three years of the date of approval;
(3) Construction in accordance with the site plan substantially ceases for any
reason, prior to completion, for a period of one year or more after commencement
of construction; or
(4) The premises has been substantially vacant or inactive for more than three years
B. An application for extension of site plan approval shall be made by the application to the
Planning Board prior to the expiration of the specific time period sought to be extended. The
Planning Board may extend all time limits for good cause shown
