Re -Introducing Local Law Resolutions to New Town Board RESOLUTION: 2026-1 Resolution Introducing Local Law No.l Of 2026 Amending The Town Code Regarding Wintertime Parking Restrictions Town of Wappinger Page 1 Printed 1/22/2026 Regular Meeting Minutes January 12, 2026 WHEREAS, in 2018, the Town Board of the Town of Wappinger adopted reforms to Chapter 230 of the Town Code. The Town finds and declares that the expeditious removal of snow from the public highways in the Town of Wappinger is required to keep the highways open for emergency vehicles during snow emergencies to protect the health, safety and welfare of the inhabitants of the Town, and WHEREAS, the Town Board had enacted a Local Law to prohibit parking on public streets and highways in the Town of Wappinger, outside the corporate limits of the Village of Wappingers Falls, pursuant to the authority granted by New York State Vehicle and Traffic Law §1660 (18) & (27), and WHEREAS, a section of Code has been identified as contradicting the Code amendments made in 2018 to only enforce that a snow emergency shall exist when the National Weather Service has issued an advisory or warning that winter weather conditions are expected to be severe, hazardous or cause significant inconvenience to the traveling public, and WHEREAS, the Town Board has determined that the Proposed Action is a Type I action pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known as "SEQRA") and pursuant to Chapter 117 of the Town Code (the Town's Environmental Quality Review Law which establishes locally designated Type I actions), and WHEREAS, the Town Board has determined that the proposed Local Law is an action for which there are no other Involved Agencies and that the Town Board is therefore, by default, the Lead Agency for this action, and NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS: 1. The Town Board of the Town of Wappinger hereby introduces for consideration of its adoption proposed Local Law No. 1 of 2026 in the form annexed hereto; the Town Code as originally adopted and amended from time to time thereafter is to remain in full force and effect and is otherwise ratified, readopted and confirmed. 2. The Town Board has reviewed the Proposed Action and hereby reserves the right to make its Determination of Significance pursuant to SEQRA at the conclusion of the Public Hearing(s) on the proposed amendments to the Town Code. 3. RESOLUTION: 2026-2 Resolution Introducing Local Law No. 2 Of 2026 Amending Chapter 122 Of The Town Code Amending Fee Schedule On Legalization Fees WHEREAS, the Town Board wishes to encourage timely compliance with applicable building, fire, zoning, and property maintenance codes by owners of residential structures through voluntary remediation, not financially penalizing residents looking to follow the law, while reserving enforcement fees for repeat or unaddressed violations, and WHEREAS, the current Fee Schedule of the Town Code mandates a "legalization fee" be paid by residents wishing to remedy violations on residential properties, and WHEREAS, it is the intent of the Town Board to not levy such penalties onto residents who are obtaining building permits to legally correct their violations, and WHEREAS, the Town Board has determined that the Proposed Action is a Type I action pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known as "SEQRA") and pursuant to Chapter 117 of the Town Code (the Town's Environmental Quality Review Law which establishes locally designated Type I actions), and WHEREAS, the Town Board has determined that the proposed Local Law is an action for which there are no other Involved Agencies and that the Town Board is therefore, by default, the Lead Agency for this action, and NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS: 1. RESOLUTION: 2026-40 Resolution Authorizing Payment To The Poughkeepsie Joint Landfill Operating Fund Replenishment Town of Wappinger Page 32 Printed 1/22/2026 Regular Meeting Minutes January 12, 2026 WHEREAS, the Town of Wappinger is a member municipality of the Poughkeepsie Joint Landfill Board of Governors, which oversees the former landfill site once located at the Hudson Valley Regional Airport in the Town of Wappinger; and WHEREAS, said landfill was jointly owned and operated by the Towns of Wappinger, Poughkeepsie, and LaGrange, the Village of Wappingers Falls, and the City of Poughkeepsie until its closure in 1974; and WHEREAS, the Town of Wappinger retains a responsibility ratio of 14.1728% for the closed landfill site; and WHEREAS, the Poughkeepsie Joint Landfill Board of Governors approved an Operating Fund Replenishment on December 10, 2025, to support the continued regular maintenance, monitoring, and upkeep of the landfill site and landfill cap; and WHEREAS, the Town of Wappinger's proportionate share of said Operating Fund Replenishment is Seven Thousand Eighty -Six Dollars and Forty Cents ($7,086.40); and NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger hereby authorizes the payment of $7,086.40 from the B -Fund Balance to the Poughkeepsie Joint Landfill Board of Governors for the purpose of Operating Fund Replenishment, as approved by the Board of Governors on December 10, 2025; and be it further NOW, THEREFORE, BE IT FURTHER RESOLVED, that Town Comptroller Daniel O. Cavaccini DOC ID: 6529 Resolution Introducing Local Law No. 2 Of 2026 Amending Chapter 122 Of The Town Code Amending Fee Schedule On Legalization Fees WHEREAS, the Town Board wishes to encourage timely compliance with applicable building, fire, zoning, and property maintenance codes by owners of residential structures through voluntary remediation, not financially penalizing residents looking to follow the law, while reserving enforcement fees for repeat or unaddressed violations, and WHEREAS, the current Fee Schedule of the Town Code mandates a "legalization fee" be paid by residents wishing to remedy violations on residential properties, and WHEREAS, it is the intent of the Town Board to not levy such penalties onto residents who are obtaining building permits to legally correct their violations, and WHEREAS, the Town Board has determined that the Proposed Action is a Type I action pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known as "SEQRA") and pursuant to Chapter 117 of the Town Code (the Town's Environmental Quality Review Law which establishes locally designated Type I actions), and WHEREAS, the Town Board has determined that the proposed Local Law is an action for which there are no other Involved Agencies and that the Town Board is therefore, by default, the Lead Agency for this action, and NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS: 1. Paoloni Initiator: MinuteTraq Admin Sponsors: DOC ID: 6537 Resolution Authorizing Payment To The Poughkeepsie Joint Landfill Operating Fund Replenishment WHEREAS, the Town of Wappinger is a member municipality of the Poughkeepsie Joint Landfill Board of Governors, which oversees the former landfill site once located at the Hudson Valley Regional Airport in the Town of Wappinger; and WHEREAS, said landfill was jointly owned and operated by the Towns of Wappinger, Poughkeepsie, and LaGrange, the Village of Wappingers Falls, and the City of Poughkeepsie until its closure in 1974; and WHEREAS, the Town of Wappinger retains a responsibility ratio of 14.1728% for the closed landfill site; and WHEREAS, the Poughkeepsie Joint Landfill Board of Governors approved an Operating Fund Replenishment on December 10, 2025, to support the continued regular maintenance, monitoring, and upkeep of the landfill site and landfill cap; and WHEREAS, the Town of Wappinger's proportionate share of said Operating Fund Replenishment is Seven Thousand Eighty -Six Dollars and Forty Cents ($7,086.40); and NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger hereby authorizes the payment of $7,086.40 from the B -Fund Balance to the Poughkeepsie Joint Landfill Board of Governors for the purpose of Operating Fund Replenishment, as approved by the Board of Governors on December 10, 2025; and be it further NOW, THEREFORE, BE IT FURTHER RESOLVED, that Town Comptroller Daniel O. Annual Report: • Andy summarized the 2025 Annual Report: o Groundwater sample results are mostly trending downward; certain parameters are trending upward consistent with waste decomposition. o Wappinger Creek samples show no landfill impact. o Landfill cover is in good condition; minor gas vent repairs are needed. • CPL will coordinate repairs with Poughkeepsie Highway Department, which cleared brush in fall 2025. Board Action: Approved submission of the report to NYSDEC unanimously. County Grant to Cover Gas Vents: • County's biofilter plan (discussed January 2024) remains pending. CPL will follow up and report back. Contracts: • Mowing Contract: Landfill mowed twice in 2025 (contract specifies monthly). No invoices have been received. CPL will follow up with contractor; twice -yearly mowing is the minimum required to control vegetation. Prager Metis: Annual retainer agreement to be signed for 2025 financial reporting. CPL: Contract renewal due in 2026; CPL to provide a 3 -year proposal similar to current agreement. Paoloni Page 1 Exhibit A Town of Wappinger Dutchess County, New York United Wappinger Water District (UWWD) Water System Improvements State Environmental Quality Review NEGATIVE DECLARATION Notice of Determination of Non -Significance Date: January 12, 2026 This notice is issued pursuant to the State Environmental Quality Review Act, Article 8 of the NYS Environmental Conservation Law and its implementing regulations at Part 617 of the New York State Code of Rules and Regulations (collectively referred to as "SEQRA"). The Town of Wappinger Town Board, as the Lead Agency under SEQRA, has determined that the proposed action described below will not have a significant adverse environmental impact and a draft environmental impact statement will not be prepared. Name of Action: United Wappinger Water District (UWWD) Water Systems Improvements Applicant(s): Town of Wappinger SEQR Status: Unlisted Description of Action: Town Board Approval of Proposed Water District Improvement PrQj ect which includes the following: • Abandon Atlas well 5 and drill two new wells within the Atlas Well Field. • Use appropriately sized gravel pack and well screens to mitigate the filter fouling issue attributed to particulate passing though these components. • The additional well to be drilled within the Atlas field will allow lower pumping rates at each well in order to provide further protection against drawing sediments from the aquifer. Location: The Atlas well field is located north of the Village of Wappinger Falls on the east bank of Wappinger Creek SEQRA Procedural Background: The Town Board has identified this action as an Unlisted Action I under SEQRA based on its review of the thresholds set forth in 6 NYCRR §§ 617.4 and 617.5. The Town Board is the designated lead agency as a result of a coordinated review with other involved agencies The involved agencies for this project to which notices were sent include: • Dutchess County Department of Health (DC DOH) • New York State Office of Parks, Recreation and Historic Preservation (OPRHP) • New York State Department of Environmental Conservation (NYSDEC) Page 1 of 4 • New York City Department of Environmental Protection (DEP) Reasons Supporting this Determination: The SEQRA regulations provide that "[f]or all Type 1 and Unlisted actions the lead agency making a determination of significance must: (1) consider the action as defined [under SEQRA]; (2) review the EAF, the criteria contained in subdivision (c) of this section and any other supporting information to identify the relevant areas of environmental concern; (3) thoroughly analyze the identified relevant areas of environmental concern to determine if the action may have a significant adverse impact on the environment; (4) set forth its determination of significance in a written form containing a reasoned elaboration and providing reference to any supporting documentation." 6 NYCRR § 617.7(b). The SEQRA regulations further provide that "to determine whether a proposed Type 1 or Unlisted action may have a significant adverse impact on the environment, the impacts that may be reasonably expected to result from the proposed action must be compared against the criteria in this subdivision [6 NYCRR 617.7]." 6 NYCRR § 617.7(c). Each criterion is discussed in more detail below. For the reasons discussed below, the Town Board of the Town of Wappinger concludes that the project will not have any significant adverse environmental impacts. a. Agricultural Resources The project will not have any significant adverse impact on agricultural resources. Agricultural uses do not exist in the project area therefore the proposed improvements have no effect on agricultural uses. b. Aesthetics The project will not have any significant adverse impacts upon the aesthetics of the area. The site is currently used as a well field and the two new wells to be installed will have a minimal impact on the aesthetics of the area. C. Noise The project will not emit a noise louder than ambient noise levels. Therefore, the project will not have any significant adverse impact to area noise. d. Stormwater No new runoff is anticipated from the two new wells. Therefore, the project will not negatively affect stormwater quality and/or quantity and no mitigation is necessary. e. Wetlands, Streams and Other Water Bodies While there are wetlands and streams in the project area, there are no significant negative impacts to them. The location of the wells will be carefully analyzed to avoid locating the wells in the wetlands or the buffers. The project is limited to the installation of two new wells in the Atlas well field area. The project will utilize vertical drilling thereby avoiding disturbance to the stream bank and bottom. f. g. Archaeological and Historic Resources The Town has initiated consultation with the New York State Historic Preservation Office (SHPO) in regard to whether the project will impair the character or quality of important archeological or historic resources. The SHPO has indicated that there are no historic properties, including archaeological and/or historic resources, affected by this undertaking. Based on the foregoing, the project will not have any significant adverse impacts on archeological or historical resources and no mitigation is necessary. h. Traffic Page 2 of 4 The proposed project will not have any significant impact on traffic, including no anticipated potential impacts to traffic due to construction related activities. The project location is adjacent to the Wappinger Creek and there are no public thoroughfares within the project area. i. Community Character The project will not create any significant adverse impacts on community character. The project includes the abandonment of one water well and the drilling of two new wells. j. Wildlife The proposed project will not have any significant adverse impacts on wildlife. No threatened or endangered species have been identified in the project area. The project is located within the existing Atlas well field. Minor disturbance to the existing habitat well field is anticipated during construction. k. Public Safety Public safety concerns are not anticipated as a result the project. The project will not entail: (1) the storage of large quantities of hazardous material or flammable or explosive materials; (2) the burial of hazardous wastes; (3) excavation or disturbance near a site used for the disposal of solid or hazardous waste; or (4) a chronic low-level discharge or emission of hazardous materials. Based on the foregoing reasons, the project will not create any significant adverse impacts to public safety. 1. Air Quality The project will not affect air quality. a. Operation of the project will not result in the emission of air pollutants with the potential to harm human health or the environment. Because there will be no significant adverse traffic impacts, no significant impact on air quality from queued vehicles is expected. b. The project will not involve incineration of refuse, will not increase the amount of land committed to industrial use, and will not increase in the density of industrial development in an existing industrial area. Therefore, there will be no significant adverse impact on air quality. Based on the foregoing, the project will not have any significant adverse impacts on air quality in the area or the region. In. Wild, Scenic and Recreational Rivers There are no nationally or State designated wild, scenic or recreational rivers in the project area. As a result, there will be no significant adverse impacts to these resources from the project. n. Ground Water No significant adverse impacts to groundwater quantity or quality will occur from the proposed project. The project is not generating any runoff or discharges to groundwater. The current well will be abandoned and two new wells will be installed. This will improve water quality based on lower pumping rates. This will also mitigate filter fouling. o. Loss of Soil, Vegetation and Other Natural Material The pro] ect will not result in any significant loss of soil, vegetation and other natural materials. P. Solid Waste Production The project does not produce any significant solid waste and therefore will not result in a significant increase in solid waste production. q. Flood Plains The proposed improvements will not have any significant adverse impacts on flood plains. Page 3 of 4 r. Public Health The project will not create any significant adverse public health impacts. The proposed water system improvements will have an overall benefit to public health through the increased water supply to the Town. S. Induced Growth The project proposes abandoning the current well and installing two new wells. This will not increase yield, but will ensure a more reliable water supply that can accommodate anticipated growth within the Town t. Demand on Services The proposed project will not create a demand on any other municipal services. U. Community Plans The project is the replacement of water wells and as such does not create a material conflict with the Town's Comprehensive Plan or goals as officially approved or adopted. V. Cumulative Impacts No significant adverse cumulative impacts are expected from this action. The project will not significantly induce growth in the Town or otherwise change the character of the surrounding property. As required by SEQRA, the Town Board considered reasonably related long-term, short-term, direct, indirect and cumulative impacts including other simultaneous or subsequent actions which are: (1) included in any long-range plan of which the project is a part; (2) likely to be undertaken as a result of the project or (3) dependent on the project. No such actions were identified. Based on the foregoing, the project will not create any significant adverse cumulative impacts. W. Conclusion For all of the reasons set forth above, the project, as described above, will not have any significant adverse impact on the environment and, therefore, the issuance of this negative declaration is warranted.
