RESOLUTION: 2025-175 Resolution Authorizing Memorandum Of Agreement With International Brotherhood Of Teamsters Local 445 WHEREAS, based on the applicable economic market in connection with recruiting and retaining certain employees of the Town, the Town has determined that there is a need to increase the hourly rate of pay for certain individuals currently employed by the Town; and Town of Wappinger Page 6 Printed 10/15/2025 Regular Meeting Minutes October 14, 2025 WHEREAS, the Town Board, after review of this matter, has determined that it is appropriate and necessary to increase the pay of certain incumbents to ensure proper staffing within the Town; and WHEREAS, the Town Supervisor Joseph D. Cavaccini has approached the collective bargaining agent for the at -issue positions and has reached terms for a memorandum of agreement ("MOA") (a copy of which is attached hereto), which the Town Board believes prudent to authorize signature of and wishes to ratify the same; and NOW, THEREFORE, BE IT RESOLVED, the Town hereby: 1. Authorizes Town Supervisor Joseph D. Cavaccini to sign and implement the attached memorandum of agreement and, also, ratifies the same. 2. Authorizes Town Supervisor Joseph D. Cavaccini to take such action as is necessary to implement the MOA, including the payment of wages either retroactively or prospectively, whichever the case may be. Should the need arise, the Town Supervisor Joseph D. Cavaccini is authorized to make minor non -substantive revisions to the MOA. RESOLUTION: 2025-183 Resolution Approving Memorandum Of Agreement With CSEA Local 1000 AFSCME AFL-CIO (CSEA) WHEREAS, the Town of Wappinger ("Town") and the CSEA, Local 100 AFSCME, AFL-CIO, Town of Wappinger Highway Employees Unit 66730, Dutchess County Local 914 Union ("Union") are parties to a Collective Bargaining Agreement, the term of which expires on December 31, 2025 (the "CBA"); and WHEREAS, the Town and the Union have been engaged in collective bargaining, which has led to a mutual understanding between the Town and the Union for the terms and conditions of employment for a successor agreement; and WHEREAS, the Town and the Union are desirous of reducing that mutual understanding to a written document. WHEREAS, the Town Supervisor Joseph D. Cavaccini has approached the collective bargaining agent for the at -issue positions and has reached terms for a memorandum of agreement ("MOA") (a copy of which is attached hereto), which the Town Board believes prudent to authorize signature of and wishes to ratify the same. MEMORANDUM OF AGREEMENT between the TOWN OF WAPPINGER and the TEAMSTER LOCAL 445 WHEREAS, the Town of Wappinger (the "Town") and the Teamster Local 445 (the "Union") (collectively referred to as the "Parties") are parties to a collective bargaining agreement, the current term of which expires on December 31, 2025 (the "CBA"); and WHEREAS, the Union is currently the bargaining representative for certain Town employees, whose terms and conditions of employment are defined within the CBA; and WHEREAS, the Parties have identified certain issues pertaining to the recruitment and retention of certain positions based on the current market rate for said positions; and WHEREAS, as a result of the difficulty recruiting and retaining employees, the parties have met to discuss the appropriate rate of pay for said positions; and WHEREAS, after engaging in negotiation over the appropriate rate of pay for the at -issue employees, the parties have agreed upon rates of pay that should be applicable to incumbents of those positions; and WHEREAS, the Parties are desirous of reducing that agreement to writing and wish to freely and voluntarily enter into this memorandum of agreement ("MOA") to enumerate their understanding of said agreement. NOW, therefore, the parties agree as follows: 1. The pay rates enumerated in Appendix A of this MOA shall be implemented effective October 12, 2025 for all incumbents referenced therein, except for the Head Groundskeeper, whose pay rate enumerated in Appendix A shall become retroactively effective to June 24, 2025. As a result of said pay increase, the parties agree to extend the term of the CBA from January 1, 2026, through and including December 31, 2026. These pay rates shall incorporate any stipends of which the applicable incumbent may be receiving at this time of ratification of this MOA. After ratification of this MOA, employees shall no longer receive any stipend beyond their regular rate of pay. 2. The parties agree that, although certain operational matters may be negotiated during the new term of the CBA, the parties agree that no additional pay increase will be sought for the 2026 calendar year unless authorized in writing by the other party. 1 This MOA is subject to ratification by the Town's Board and, if required, by the Union. 4. Unless explicitly provided for within this MOA, the terms of the CBA shall continue unchanged through the end of the new term of the CBA. The terms of this MOA shall be incorporated into the CBA as enumerated above. 5. This MOA represents the entire understanding and agreement between the parties in relation to the matters discussed herein. No modification of this MOA shall be valid unless it is in writing and signed by the parties hereto. 6. Each party hereto acknowledges that they have read the MOA, fully understands it, and have had all questions that they may have in regard thereto answered. Each parry, being competent and of sound mind, enters into this MOA of their own free will and has not been coerced into doing so. 7. Paoloni Page 1 TOWN OF WAPPINGER Local Law No. 6 of 2025 A LOCAL LAW EXTENDING THE LOCAL LAW REGULATING FOR AN INTERIM PERIOD, THE RECEIPT, PROCESSING, AND APPROVAL OF APPLICATIONS FOR SUBDIVISIONS GREATER THAN THREE LOTS AND APPLICATIONS FOR MULTI- FAMILY RESIDENTIAL DEVELOPMENT WITHIN THE TOWN OF WAPPINGER. Section I TITLE This Local Law shall be known and may be cited as the Extension of the Interim Development Law of the Town of Wappinger. Section II LEGISLATIVE INTENT AND FINDINGS OF FACT A. Background. This local law is intended to extend the Interim Development Law for an additional six month period while the Town Board reviews its existing comprehensive plan for amendments, updates, and revisions, and potential revisions to the zoning code related thereto. By resolution dated March 11, 2024 the Town Board adopted Local Law # 1 prohibit the receipt, processing and approval of applications for residential subdivisions greater than three lots and applications for multifamily housing for a period of eighteen (18) months. The Town has diligently worked to update the comprehensive plan and draft comprehensive regulation, however, despite these efforts, it is deemed necessary to extend this prohibition for six (6) months in order for the Board to continue its review and update to the comprehensive plan and related zoning amendments. During this extended prohibition, the Town will work to finalize and eventually adopt an updated comprehensive plan and land use provisions and regulatory processes to provide for the benefit, health and safety of the residents of Wappingers. B. Legislative Findings of Fact. The Town Board of the Town of Wappinger (the "Town Board") does hereby find that, pending the completion of the research, studies, surveys, informational meetings, public hearings and other actions incident to proper consideration and decisions to update the comprehensive master plan and revisions and make amendments of the Town Zoning Code and subdivision regulations, appropriate measures must be taken for a reasonable interim period to protect the public interest. The Town Board also finds that the further review and approval of significant new development when an updated comprehensive plan may recommend changes in the existing zoning code may destroy the integrity of the comprehensive plan and the amendments' basic purposes, comprehensive aspects and intentions. Section III SCOPE OF CONTROLS During the effective period of this law and effective as provided herein: The Planning Board shall not accept, review, or grant, nor shall any other board, department, or agency of the Town accept, review, or grant, any application for approval of a subdivisions creating greater than three lots (including the existing lot) and/or/or together with applications for or including new multi -family residential development, unless a complete application has been filed and a negative declaration and/or Final Environmental Impact Statement has been approved. Section IV APPEALS PROVISIONS A. The Town Board shall have the power to vary or modify the application of any provision of this Local Law upon its determination, in its absolute legislative discretion, that such variance or modification is consistent with the spirit of the intended master plan and prospective zoning code amendments upon which this local law is based and with the health, safety and general welfare of the Town, and upon finding that the application of the provisions of this local law to a specific property will cause undue economic hardship and that such hardship is unique to that specific property. B. Upon receiving any application for such variance or modification, the Town Board shall refer such application to the Planning Board for a report of said Planning Board with respect to the effect of the prospective variance or modification upon the intended comprehensive plan. To expedite the appeal, the Town clerk shall forward, within forty-eight (48) hours after receipt of same, all applications for relief to the Planning Board for its report. Such report shall be returned by the Planning Board to the Town Board within thirty (30) days of such reference and shall be placed on the next agenda of the Town Board for a determination after expiration of said thirty -day period or receipt of a report from the Planning Board, whichever is earlier. The granting of an appeal for relief by the Town Board shall authorize and permit the Planning Board to accept, review, consider, and otherwise act. C. In deciding on a proposed exemption or grant of relief from application of the moratorium, the Town Board may obtain and consider reports and information from any source it deems to be helpful with review of said application. D. A grant of relief from application of the moratorium shall include a determination of unreasonable hardship upon the property owner (or if there are multiple property owners, a determination that each such owner shall suffer an unreasonable hardship) which is unique to the property owner(s), a finding that there are sufficient existing regulations to adequately govern the application for which a hardship waiver is being requested, and a finding that the grant of an exemption will be in harmony with, and will be consistent with the existing Town of Wappinger Zoning Ordinance and the recommendations of the Comprehensive Plan as such may exist. E. An application for relief from the prohibitions of the moratorium shall be accompanied by a fee as set forth by resolution of the Town Board, together with the applicant's written undertaking, in a form to be approved by the Attorney for the Town, to pay all of the expenses of the Town Board and any agent or consultant retained by the Town Board to evaluate and consider the merits of such application, including but not limited to any fees incurred by the Town for services provided by the Attorney for the Town. Section V PENALTIES A. Any person, firm, entity, or corporation that shall violate any of the provisions of this local law shall be subject to penalties as otherwise provided by law or ordinance of the Town of Wappinger for violation of provisions of Chapter 240 of the Town Code (Zoning). B. Additionally, failure to comply with any of the provisions of this Local Law shall be an unclassified misdemeanor as contemplated by Article 10 and Section 80.05 of the New York State Penal Law, and, upon conviction thereof, shall be punishable by a fine of not more than One Thousand Dollars ($1,000) or imprisonment for not more than 10 days, or both for the first offense. Any subsequent offense within a three-month period shall be punishable by a fine of not more than Two Thousand Dollars ($2,000) or imprisonment for a period of not more than 30 days, or both. For purposes of this Clause A., each day that a violation of this Local Law exists shall constitute a separate and distinct offense. C. Compliance with this Local Law may also be compelled and violations restrained by order or by injunction of a court of competent jurisdiction, in an action brought on behalf of the Town by the Town Board. D. In the event the Town is required to take legal action to enforce this Local Law, the violator will be responsible for any and all costs incurred by the Town relative thereto, including attorney's fees, and such amount shall be determined and assessed by the court. If such expense is not paid in full within 30 days from the date it is determined and assessed by the Court, such expense shall be charged to the property(ies) within the Town on which the violation occurred, by including such expense in the next annual Town tax levy against such property, and such expense shall be a lien upon such property until paid. Section VI APPLICATION This law shall apply to subdivisions greater than three lots (including the lot to be subdivided) and new multi -family residential developments within the Town of Wappinger. Section VII VALIDITY The invalidity of any word, section, clause, paragraph, sentence, part or provision of this local law shall not affect the validity of any other part of this local law which shall be given effect without such invalid part or parts. Section VIII EXEMPTION This local law shall not apply to the following: (1) subdivisions that create less than three parcels including the existing parcel; (2) to the premises which are the subject of the case In the Matter of the Application ofMid-Hudson Development Corp. and Mid -Hudson Holdings, LLC v. Section IX REPEAL OF OTHER LAWS A. To the extent that any provisions of this local law are in conflict with or are construed as inconsistent with the provisions of the New York State Town Law or any local ordinance, law, or regulation, this local law supersedes, amends, and takes precedence over the Town Law and such local ordinances, laws or regulations, pursuant to the Town's municipal home rule powers pursuant to Municipal Home Rule Law § 10 and § 22 to supersede any inconsistent authority. B. Pursuant to the same powers, and without limiting the generality of the foregoing, this local law, during the duration of time that this law is in effect, supersedes the following: (1) The provisions contained in Article 8 of the Environmental Conservation Law (known as the State Environmental Quality Review Act) and the regulations thereunder to the extent that such provisions require that an agency determine the environmental significance of an application within certain specified timeframes; (2) The provisions of Town Law § 267 and § 267-a through c, pertaining to the variance authority of the board of zoning and appeals. (3) The provisions of Town Law, Article 16, Section 276(5)(d)(iii): Decision. The planning board shall approve, with or without modification, or disapprove such preliminary plat as follows: (1) If the planning board determines that the preparation of an environmental impact statement on the preliminary plat is not required such board shall make its decision within sixty-two days after the close of the public hearing; or (2) If the planning board determines that an environmental impact statement is required, and a public hearing is held on the draft environmental impact statement, the final environmental impact statement shall be filed within forty-five days following the close of such public hearing in accordance with the provisions of the state environmental quality review act. If no public hearing is held on the draft environmental impact statement, the final environmental impact statement shall be filed within forty-five days following the close of the public hearing on the preliminary plat. Within thirty days of the filing of such final environmental impact statement, the planning board shall issue findings on the final environmental impact statement and make its decision on the preliminary plat. (4) The provisions of Town Law, Article 16, Section 276(5)(e)(iii): Decision. The planning board shall by resolution approve with or without modification or disapprove the preliminary plat as follows: (1) If the preparation of an environmental impact statement on the preliminary plat is not required, the planning board shall make its decision within sixty- two days after the close of the public hearing on the preliminary plat. (2) If an environmental impact statement is required, the planning board shall make its own findings and its decision on the preliminary plat within sixty-two days after the close of the public hearing on such preliminary plat or within thirty days of the adoption of findings by the lead agency, whichever period is longer. (5) The provisions of Town Law, Article 16, Section 276(8): Default approval of preliminary or final plat. The time periods prescribed herein within which a planning board must take action on a preliminary plat or a final plat are specifically intended to provide the planning board and the public adequate time for review and to minimize delays in the processing of subdivision applications. Such periods may be extended only by mutual consent of the owner and the planning board. In the event a planning board fails to take action on a preliminary plat or a final plat within the time prescribed therefor after completion of all requirements under the state environmental quality review act, or within such extended period as may have been established by the mutual consent of the owner and the planning board, such preliminary or final plat shall be deemed granted approval. The certificate of the town clerk as to the date of submission of the preliminary or final plat and the failure of the planning board to take action within the prescribed time shall be issued on demand and shall be sufficient in lieu of written endorsement or other evidence of approval herein required. (6) Any other additional inconsistent provisions of Town Law, Article 16, including but not necessarily limited to, Sections 264, 265, 274-a, 276, 277, 278, and 279. Section X. DEFAULT APPROVAL Notwithstanding any provision of Town Law to the contrary, and specifically based upon the supersession of the Town Law Sections 276(5)(d), 276(5)(e) and 276(8) recited in Section IX(B)(3), (4), and (5) above, during the period that this local law, or any extension thereof, is in effect, in reviewing subdivision applications as may be permitted by this local law, the failure of the planning board to take action upon any application for approval of a preliminary or final subdivision plat application shall not be deemed an approval of such application and the town clerk shall not issue a certificate of approval therefor. Section XI. VALIDITY AND SEVERABILITY If any part or provision of this local law or the application thereof to any person or circumstance be adjudged invalid by any court of competent jurisdiction, such judgment shall be confined in its operation to the part or provision or application directly involved in the controversy in which such judgment shall have been rendered and shall not affect or impair the validity of the remainder of this local law or the application thereof to other persons or circumstance, and the Town Board of the Town of Wappinger hereby declares that it would have passed this local law or the remainder thereof had such invalid application or invalid provision been apparent. Section XII. EFFECTIVE DATE This local law shall take effect immediately, as provided by law, and shall remain in force for a consecutive six (6) months from its effective date, unless extended by local law adopted after public hearing upon no less than five (5) days' notice published in the official newspaper of the Town of Wappinger. In addition, the Employer shall supply a listing of Highway employees who terminate their employment or upon the initial hiring of an employee. 7. Article II, Paid Lunch, shall be amended to read as follows: The Highway Superintendent is authorized to designate a period of time beginning December 1st and ending March 31" of each year when employees may take a �/z hour paid lunch time. The Highway Superintendent will permit employees to return to the highway garage for the lunch period when feasible, with due consideration of open job sites and incomplete jobs where continuous monitoring may be necessary. This benefit is intended to provide employees relief from cold weather and winter storm conditions, not dry weather above 45 degrees F. The Highway Superintendent shall be permitted to manage the use of this benefit to suppress the cost of the benefit for fuel and time management. During any period so designated above, the working hours will be amended to reflect a workday beginning at 7:00 am and ending at 3:00 pm inclusive of a thirty (30) minute paid lunch period. 8. Article III, Section 1, Wages, shall be amended to read as follows: All rates of pay set forth in APPENDIX A shall be adjusted as follows: Effective January 1, 2026 — The Head Mechanic's hourly wage shall be increased by one dollar ($1.00) per hour. Effective January 1, 2026 — All wages and salaries shall be increased by three (3%) percent. Effective January 1, 2027 — All wages and salaries shall be increased by two and one-half (2.5%) percent. Effective January 1, 2027 — Step 6 of each title within the salary schedule shall be increased by one-half (0.5%) percent. Effective January 1, 2028 — All wages and salaries shall be increased by two and one-half (2.5%) percent. Article III, Section 1, Longevity, shall be amended by adding the following language: Longevity payments will be added to the base annual salary or base hourly salary as the case may be, shall be cumulative, and shall be paid on the employee's anniversary date with due consideration given to all employees with prior years of service with the Town (referenced in Appendix "A"). Article VI, Section 4, shall be amended to read as follows: Subject to compliance with applicable laws, any layoffs shall be done in reverse order of seniority within the bargaining unit. Recall from layoffs will be according to seniority when doing so would be in compliance with applicable laws. 24. Article IX, Section 1, shall be amended by deleting the final sentence of said provision. 25. Article IX, Section 3, shall be amended by amending the second sentence to read The Committee shall consist of the Town Supervisor and/or their designee and three (3) union members. 26. Article IX, Section 3, shall be amended by adding the following sentence after the current final sentence: Any agreements made by the parties during a labor management meeting shall be reduced to writing and, when necessary, be subject to ratification prior to the agreement becoming effective. 27. Article IX, Section 5, shall be amended to read as follows: The following disciplinary procedure shall be applicable in lieu of the provisions of Sections 75 and 76 of the New York State Civil Service Law. All discipline shall be progressive utilizing the steps below and for just cause. The Employer is not precluded from utilizing the same or lower steps of the disciplinary process for subsequent disciplinary actions. Steps 1 and 2 below shall not be subject to the grievance procedure. Challenges to Steps 3 through 5 of the disciplinary process shall commence upon the submission of a demand for arbitration pursuant to Article IX, Section 6, Stage III of the grievance procedure. However, the penalty of a disciplinary matter involving Steps 3 through 5 may be implemented prior to arbitration discussed within said section. A disciplinary action shall commence upon presentation of written charges to the employee. There shall be a five (5) step discipline process. 1. Verbal Warning 2. Written Reprimand 3. Termination The Town shall commence a disciplinary action for any act or omission on the part of an employee, which endangers the safety, health or welfare of another employee, citizen, or property of the Town, at Step 4 or 5 (as enumerated above), based on severity. Any and all disciplinary verbal warnings and/or write-ups issued to any employee of the Highway Department from May 1, 2015, up to the ratification of this MOA shall be of no force and effect with respect to any future disciplinary matter concerning such employee. 28. Article IX, Section 6, shall be amended to read as follows: A. DEFINITIONS A contract grievance is a dispute concerning the interpretation, application or claimed violation of a specific term or provision of this Agreement. Other disputes, which do not involve the interpretation, application, or claimed violation of a specific term or provision of this Agreement, including matters as to which other means of resolution are provided or foreclosed by this Agreement, or by statute or administrative procedures applicable to the Town, shall not be considered contract grievance. B. BASIC PRINCIPLES 1. It is the intent of these procedures to provide for the orderly settlement of differences in a fair and equitable manner. The resolution of a grievance at the earliest possible stage is encouraged. 2. An employee shall have the right to present grievances in accordance with these procedures, free from coercion, interference, restraint, discrimination or reprisal. 3. An employee shall have the right to be represented at any stage of the procedures by a person or persons of their own choice. 4. Each party to a grievance shall have access at reasonable times to all written statements and records pertaining to such case. 5. All hearings shall be confidential. 6. It shall be the responsibility of the Town to take such steps as may be necessary to give force and effect to these procedures. The Town shall have the responsibility to consider promptly each grievance presented and make a determination within the authority delegated to them within the time specified in these procedures. 7. The function of these procedures is to assure equitable and proper treatment under the Agreement and existing laws, rules, regulations and policies, which relate to or affect the employees in the performance of their assignment. They are not designed to be used for changing such rules or establishing new ones. Page 5 of 11 10.9.2025 8. The Stages of this grievance procedure and the associated timelines shall only be waivable in writing. Should the Employer fail to respond within the time period provided under these stages, it shall be considered a denial of the grievance, and the matter will then progress to the next Stage. C. PROCEDURES A grievance shall be processed in accordance with the following stages: STAGE I - An aggrieved parry shall present a written grievance to the Office of the Town of Wappinger Superintendent of Highways no later than forty-five (45) calendar days after such parry knew or should have known of the subject matter of the grievance. The Town's Superintendent of Highways shall render a written determination to the aggrieved party within a period of ten (10) working days after the submission of the grievance. STAGE II - In the event such grievance is not resolved at Stage I, CSEA shall file a written appeal to the Town Board (by providing it to the Board's designee) within ten (10) working days of the Stage I determination or if there is no Stage 1 determination, when the Stage 1 determination should have been provided. The Town Board will then consider the grievance in executive session at the next practicable Town Board meeting. Within ten (10) working days from the meeting of the Town Board at which the appeal is discussed, the Town Board's written determination shall be provided to CSEA. The Town Board will commence a meeting no more than thirty (30) calendar days after such appeal is presented to them. If more than thirty calendar days are required, the Town Board or their designee will notify CSEA in writing, and such will be discussed amongst the parties. STAGE III - In the event such grievance is not disposed of under a previous stage, the Employer or CSEA, not later than twenty (20) business days after the Stage II determination, shall have the right to submit the issue to binding arbitration before an impartial arbitrator by filing a demand for arbitration with the other party's designee. In the event the parties are unable to voluntarily agree upon an impartial arbitrator within twenty (20) working days after the filing of the demand for arbitration as provided above, then the o Voluntary Labor Arbitration Rules of the Public Employment Relations Board (PERB) shall be v applied to the proceeding for the purpose of selecting an arbitrator. The demand for arbitration w W shall include a brief statement setting forth precisely the express provision of this Agreement to be interpreted by the arbitrator. c The decision of the arbitrator shall be binding on the parties. The arbitrator's fee and the costs and expenses of the arbitration proceeding will be shared equally by the parties to the dispute. The arbitrator shall have no authority to create, modify, or remove any contractual provision. 29. Article IX, Section 12, shall be amended by amending the final sentence to read: Any employee who needs to be available for an emergency call during the day will be allowed to stop work to attend to said call so long as doing so would still allow for the safe and efficient operation (as determined by the Employer) of the work being performed by said employee. Employees, whenever possible, shall notify their supervisor on days in which they may need to handle an emergency phone before commencing work on such days. Page 6 of 11 10.9.2025 30. Rules For Salary Schedule, shall be amended in the following ways: Deleting: "Step advancement for eligible employees shall be made on January 1 of each year according to the following criteria: A. An employee shall have completed five (5) months of service by December 31 st in the year they were hired, in order to receive an increment. B. All new employees hired at Step 1 will advance one (1) increment on January 1 of each year, provided they have completed five (5) months of service by December 31st, in order to receive an increment." Adding the following in its place: Effective October 1, 2025, Step advancement shall occur on an eligible employee's one (1) -year anniversary and each year thereafter on their anniversary date until they reach the top increment. 31. Salary Schedule (Appendix A), shall be amended to reflect the new wages as attached hereto as Appendix A. 32. The terms of the MOA entered into by the parties on or about March 5, 2024, shall also be incorporated into the CBA as is enumerated within said MOA. A true and accurate copy of said MOA is attached hereto as Appendix B. 33. This MOA is the full understanding of the parties as to the terms of this agreement. Paoloni Initiator: MinuteTraq Admin Sponsors: DOC ID: 6452 An Order Making Certain Determinations in Relation to and Approving the Establishment of Extension No. 12 Wappingers Falls Mobile Home Park, Inc. ) to United Wappinger Water District of the Town of Wappinger, Dutchess County, New York, Pursuant to Article 12 of The Town Law WHEREAS, a Petition and a related map, plan and report has been submitted to the Town Board of the Town of Wappinger by Wappinger Falls Mobile Home Park, Inc. in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Wappinger, Dutchess County, New York, for the establishment of Extension No. 12 to connect the Wappingers Falls Mobile Home Park, Inc. to the United Wappinger Water District of said Town (the "Extension"); and WHEREAS, said map, plan and report were prepared by a competent engineer, duly licensed by the State of New York, and have been filed in the office of the Town Clerk of said Town, where the same are available during regular office hours for examination by any persons interested in the subject matter thereof; and WHEREAS, said Extension shall be bounded and described as hereinafter set forth; and WHEREAS, the improvements proposed for said Extension consist of the purchase and installation of water mains, valves and hydrants, including original equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, all as more fully described in the map, plan and report hereinbefore described; and WHEREAS, the maximum amount proposed to be expended for said improvements is $160,000; and WHEREAS, the Town of Wappinger Town Board has determined that the extension of the United Wappinger Water District to provide water service to the existing parcel is an Unlisted Action under SEQRA pursuant to 6 NYCRR 617.5(c)(13); and WHEREAS, the cost of said improvements shall be paid by the owner of the property therein and no serial bonds of said Town shall be issued therefor; and WHEREAS, the estimated cost of the establishment of the Extension will be borne by the property owner which will include a connection fee in the amount of approximately $78,750 based on actual water usage and operation and maintenance will be billed by assessed by benefit unit in accordance with the provisions of the Town Code; and WHEREAS, the boundaries of said Extension shall be as described in Schedule A attached hereto and hereby incorporated herein; and WHEREAS, a Resolution was duly adopted by said Town Board on September 8, 2025, authenticating the Petition and referencing the details therein including the boundaries of the Extension, confirming the acceptance of map, plan and report and that said Petition and map, plan and report were on file in the Town Clerk's Office for public inspection and specifying the 22 day Updated: 9/18/2025 12:54 PM by Joseph P. It is in the public interest to grant the relief sought in the Petition, it being acknowledged that the water supply currently serving the Wappinger Falls Mobile Home Park, Inc. property no longer meets the applicable criteria promulgated by the New York State Health Department for potable water and the Extension is necessary for the provision of potable water to the residents of the Wappinger Falls Mobile Home Park. 3. The notice of hearing was published and posted as required by law and is otherwise sufficient. 4. That all the property and property owners within said Extension are benefited thereby and that all of the property and property owners benefited are included within the limits of said proposed Extension. 5. The Extension to be bounded and described as hereafter set forth, and the improvement therefor consisting of the purchase and installation of water mains, valves, and hydrants, including original equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, with all costs borne by the owner of the property is in the best interest of the Town. 6. Said Extension (Wappingers Falls Mobile Home Park, Inc.) to United Wappinger Water District shall be bounded and described as set forth in Exhibit A attached hereto and hereby made a part hereof. 7. The Town Clerk shall, within ten (10) days after the effective date of this resolution, file certified copies of this resolution in duplicate in the Office of the State Department of Audit and Control at Albany, New York. 8. The Town Clerk shall, within ten (10) days after the effective date of this resolution, file certified copies of this resolution in the Office of the Dutchess County Clerk. 9.
