2025-175 (2)TOWN OF WAPPINGER TOWN BOARD RESOLUTION NO. -2025 October , 2025 WHEREAS, based on the applicable economic market in connection with recruiting and retaining certain employees of the Town, the Town has determined that there is a need to increase the hourly rate of pay for certain individuals currently employed by the Town; and WHEREAS, the Town Board, after review of this matter, has determined that it is appropriate and necessary to increase the pay of certain incumbents to ensure proper staffing within the Town; and WHEREAS, the Town Supervisor Joseph D. Cavaccini has approached the collective bargaining agent for the at -issue positions and has reached terms for a memorandum of agreement ("MOA") (a copy of which is attached hereto), which the Town Board believes prudent to authorize signature of and wishes to ratify the same. NOW, THEREFORE, BE IT RESOLVED, the Town hereby: 1. Authorizes Town Supervisor Joseph D. Cavaccini to sign and implement the attached memorandum of agreement and, also, ratifies the same. 2. Authorizes Town Supervisor Joseph D. Cavaccini to take such action as is necessary to implement the MOA, including the payment of wages either retroactively or prospectively, whichever the case may be. Should the need arise, the Town Supervisor Joseph D. Cavaccini is authorized to make minor non -substantive revisions to the MOA. MEMORANDUM OF AGREEMENT between the TOWN OF WAPPINGER and the TEAMSTER LOCAL 445 WHEREAS, the Town of Wappinger (the "Town") and the Teamster Local 445 (the "Union") (collectively referred to as the "Parties") are parties to a collective bargaining agreement, the current term of which expires on December 31, 2025 (the "CBA"); and WHEREAS, the Union is currently the bargaining representative for certain Town employees, whose terms and conditions of employment are defined within the CBA; and WHEREAS, the Parties have identified certain issues pertaining to the recruitment and retention of certain positions based on the current market rate for said positions; and WHEREAS, as a result of the difficulty recruiting and retaining employees, the parties have met to discuss the appropriate rate of pay for said positions; and WHEREAS, after engaging in negotiation over the appropriate rate of pay for the at -issue employees, the parties have agreed upon rates of pay that should be applicable to incumbents of those positions; and WHEREAS, the Parties are desirous of reducing that agreement to writing and wish to freely and voluntarily enter into this memorandum of agreement ("MOA") to enumerate their understanding of said agreement. NOW, therefore, the parties agree as follows: 1. The pay rates enumerated in Appendix A of this MOA shall be implemented effective October 12, 2025 for all incumbents referenced therein, except for the Head Groundskeeper, whose pay rate enumerated in Appendix A shall become retroactively effective to June 24, 2025. As a result of said pay increase, the parties agree to extend the term of the CBA from January 1, 2026, through and including December 31, 2026. These pay rates shall incorporate any stipends of which the applicable incumbent may be receiving at this time of ratification of this MOA. After ratification of this MOA, employees shall no longer receive any stipend beyond their regular rate of pay. 2. The parties agree that, although certain operational matters may be negotiated during the new term of the CBA, the parties agree that no additional pay increase will be sought for the 2026 calendar year unless authorized in writing by the other party. 1 This MOA is subject to ratification by the Town's Board and, if required, by the Union. 4. Unless explicitly provided for within this MOA, the terms of the CBA shall continue unchanged through the end of the new term of the CBA. The terms of this MOA shall be incorporated into the CBA as enumerated above. 5. This MOA represents the entire understanding and agreement between the parties in relation to the matters discussed herein. No modification of this MOA shall be valid unless it is in writing and signed by the parties hereto. 6. Each party hereto acknowledges that they have read the MOA, fully understands it, and have had all questions that they may have in regard thereto answered. Each parry, being competent and of sound mind, enters into this MOA of their own free will and has not been coerced into doing so. 7. This MOA may be executed in one or more counterpart and electronic, scanned, or facsimile signatures shall have the same force and effect as original signatures for all purposes.
